第 一 章引 言背 景1.1 為 解 決 自 七 十 年 代 初 期 罪 案 出 現 上 升 趨 勢 的 問 題 , 政 府 在一 九 七 三 年 三 月 成 立 撲 滅 暴 力 罪 行 委 員 會 , 由 當 時 的 民 政 司 出 任 主席 , 成 員 均 為 政 府 人 員 。 委 員 會 的 職 權 範 圍 為 策 劃 、 組 織 及 統 籌 政 府與 市 民 合 力 協 助 警 方 撲 滅 暴 力 罪 行 的 活 動 。 一 九 七 五 年 , 撲 滅 暴 力 罪行 委 員 會 易 名 為 撲 滅 罪 行 委 員 會 ( 委 員 會 ) , 成 員 擴 大 至 包 括 非 政 府 人員 。1.2 一 九 八 三 年 五 月 , 委 員 會 改 組 , 由 當 時 的 布 政 司 出 任 主 席 。委 員 會 的 工 作 是 制 定 撲 滅 罪 行 計 劃 、 統 籌 滅 罪 工 作 和 查 察 所 得 成 果 ,並 向 當 時 的 港 督 報 告 工 作 進 展 。 一 九 八 三 年 十 二 月 , 改 組 後 的 委 員 會向 當 時 的 港 督 呈 交 第 一 號 報 告 書 。1.3 本 報 告 書 是 委 員 會 的 第 二 十 四 號 報 告 書 , 詳 述 撲 滅 罪 行 委員 會 在 二 零 零 四 年 的 工 作 。撲 滅 罪 行 委 員 會 及 屬 下 小 組 委 員 會1.4 委 員 會 由 十 六 名 成 員 組 成 , 其 中 八 名 是 公 眾 人 士 , 由 政 務司 司 長 委 任 , 另 外 八 名 則 是 政 府 有 關 決 策 局 及 部 門 的 首 長 。 委 員 會 的職 權 範 圍 和 成 員 名 單 詳 列 於 附 錄 I(a) 及 I(b)。 委 員 會 轄 下 設 有 兩 個 小組 委 員 會 :• 青 少 年 罪 犯 問 題 常 務 委 員 會• 宣 傳 小 組 委 員 會各 小 組 委 員 會 的 職 權 範 圍 和 成 員 名 單 詳 列 於 附 錄 II(a) 及 II(b)。主 要 研 究 事 項1.5 二 零 零 四 年 , 委 員 會 共 舉 行 了 五 次 會 議 , 除 了 探 討 整 體 罪案 和 商 業 罪 案 的 情 況 、 監 察 警 司 警 誡 計 劃 的 進 展 、 推 動 撲 滅 罪 行 的 宣傳 工 作 和 督 導 分 區 滅 罪 委 員 會 ( 分 區 滅 罪 會 ) 的 工 作 之 外 , 還 就 懲 教 署 有關 罪 犯 更 生 計 劃 的 新 措 施 作 出 討 論 。分 區 撲 滅 罪 行 委 員 會1.6 全 港 十 八 區 均 設 有 分 區 滅 罪 會 , 成 員 包 括 政 府 和 非 政 府 人員 。 這 些 分 區 滅 罪 會 肩 負 重 任 , 致 力 推 廣 和 鼓 勵 居 民 參 與 區 內 的 滅 罪9

第 二 章二 零 零 四 年 罪 案 情 況整 體 罪 案 情 況2.1 二 零 零 四 年 , 向 警 方 舉 報 的 罪 案 共 有 81 315 宗 , 較 二 零 零三 年 的 88 377 宗 減 少 8.0%。 罪 案 率 ( 即 按 每 10 萬 名 人 口 計 算 的 報 案 數字 ) 為 1 181.5 宗 , 較 二 零 零 三 年 的 1 299.1 宗 減 少 9.1%。 二 零 零 四 年的 整 體 罪 案 破 案 率 為 43.6%, 二 零 零 三 年 則 為 39.2%。2.2 一 九 九 五 年 至 二 零 零 四 年 整 體 罪 案 舉 報 數 字 、 罪 案 率 和 破案 率 的 圖 表 載 於 附 錄 IV。暴 力 罪 案2.3 二 零 零 四 年 的 暴 力 罪 案 ( 包 括 兇 殺 、 強 姦 、 非 禮 、 傷 人 、 嚴重 毆 打 、 搶 劫 、 綁 架 、 勒 索 、 刑 事 恐 嚇 和 縱 火 等 ) 共 有 13 890 宗 , 較 二零 零 三 年 的 14 542 宗 減 少 4.5%。 暴 力 罪 案 減 少 , 主 要 是 搶 劫 、 傷 人 和勒 索 案 減 少 所 致 。 年 內 的 暴 力 罪 案 率 為 按 每 10 萬 名 人 口 計 算 有 201.8宗 , 較 二 零 零 三 年 的 213.8 宗 減 少 5.6%。 二 零 零 四 年 的 暴 力 罪 案 破 案率 為 57.4%, 二 零 零 三 年 則 為 52.4%。2.4 一 九 九 五 年 至 二 零 零 四 年 暴 力 罪 案 舉 報 數 字 、 罪 案 率 和 破案 率 的 圖 表 載 於 附 錄 V。某 幾 類 罪 案 的 分 析搶 劫2.5 二 零 零 四 年 的 搶 劫 案 共 有 2 237 宗 , 較 二 零 零 三 年 的 3 215宗 減 少 30.4%( 見 附 錄 VI 的 圖 表 ) 。2.6 二 零 零 四 年 有 3 宗 使 用 真 槍 行 劫 的 案 件 , 二 零 零 三 年 則 沒有 。 年 內 使 用 電 槍 行 劫 的 案 件 有 7 宗 , 而 使 用 類 似 手 槍 物 體 行 劫 的 案件 則 有 47 宗 。 上 述 兩 類 罪 案 在 二 零 零 三 年 分 別 有 4 宗 和 44 宗 ( 見 附 錄VII 的 圖 表 ) 。2.7 二 零 零 四 年 的 銀 行 劫 案 有 16 宗 , 而 二 零 零 三 年 則 有 34 宗 。至 於 金 舖 / 錶 行 劫 案 , 二 零 零 四 年 有 6 宗 , 較 二 零 零 三 年 的 9 宗 減 少3 宗 。 一 九 九 五 年 至 二 零 零 四 年 銀 行 和 金 舖 / 錶 行 劫 案 的 舉 報 數 字 ,載 於 附 錄 VIII。11
爆 竊2.8 二 零 零 四 年 的 爆 竊 案 有 7 002 宗 , 較 二 零 零 三 年 的 9 076 宗減 少 22.9%( 見 附 錄 IX 的 圖 表 ) 。兇 殺2.9 二 零 零 四 年 的 兇 殺 案 有 45 宗 , 二 零 零 三 年 則 有 52 宗 ( 見 附錄 X 的 圖 表 ) 。 在 這 45 宗 兇 殺 案 中 , 有 20 宗 (44.4%) 是 和 家 庭 問 題 有關 , 同 類 的 案 件 在 二 零 零 三 年 則 有 17 宗 (32.7%)。 年 內 , 有 9 宗 兇 殺案 共 9 名 年 齡 在 12 歲 或 以 下 的 兒 童 被 父 母 殺 害 , 而 在 二 零 零 三 年 , 這類 案 件 有 7 宗 。傷 人 及 嚴 重 毆 打2.10 二 零 零 四 年 的 傷 人 及 嚴 重 毆 打 案 件 有 7 161 宗 , 較 二 零 零 三年 的 7 147 宗 增 加 0.2%( 見 附 錄 XI 的 圖 表 )。 在 二 零 零 四 年 , 上 述 案 件中 與 三 合 會 有 關 的 佔 8.8%, 二 零 零 三 年 則 佔 9.1%。嚴 重 毒 品 罪 行2.11 二 零 零 四 年 , 嚴 重 毒 品 罪 行 ( 例 如 販 運 、 製 造 和 藏 有 危 險 藥物 等 ) 有 2 167 宗 , 較 二 零 零 三 年 的 2 142 宗 增 加 1.2%。 年 內 因 干 犯 嚴重 毒 品 罪 行 被 捕 者 共 有 2 712 人 , 較 二 零 零 三 年 的 2 746 人 減 少 1.2%。此 外 , 年 內 被 捕 的 21 歲 以 下 青 少 年 有 499 人 , 較 二 零 零 三 年 的 454 人增 加 9.9%。 在 這 些 被 捕 的 青 少 年 中 , 有 455 人 (91.2%) 因 涉 及 精 神 藥 物而 被 拘 捕 。店 舖 盜 竊2.12 年 內 向 警 方 舉 報 的 店 舖 盜 竊 有 9 186 宗 , 較 二 零 零 三 年 的9 304 宗 減 少 1.3%( 見 附 錄 XII 的 圖 表 )。 在 這 些 盜 竊 案 中 , 有 6 368 宗案 件 (69.3%) 的 被 盜 財 物 , 價 值 在 港 幣 200 元 或 以 下 。報 失 車 輛2.13 年 內 報 失 的 車 輛 有 1 740 輛 , 較 二 零 零 三 年 的 2 301 輛 減 少24.4%( 見 附 錄 XIII 的 圖 表 )。2.14 涉 及 名 貴 汽 車 ( 平 治 、 寶 馬 、 凌 志 及 豐 田 皇 冠 ) 的 案 件 下 降 至60 宗 , 較 二 零 零 三 年 的 90 宗 減 少 33.3%。 年 內 涉 及 吉 普 車 的 案 件 有23 宗 , 較 二 零 零 三 年 的 108 宗 減 少 78.7%。 涉 及 高 性 能 車 輛 失 竊 的 案件 有 43 宗 , 較 二 零 零 三 年 的 158 宗 減 少 72.8%。 偷 竊 貨 櫃 車 拖 頭 的 案件 下 降 至 47 宗 , 較 二 零 零 三 年 的 100 宗 減 少 53.0%。12
2.15 年 內 尋 回 失 車 的 整 體 百 分 率 為 48.0%, 二 零 零 三 年 則 為55.2%。街 頭 行 騙2.16 年 內 , 街 頭 騙 案 有 479 宗 , 較 二 零 零 三 年 的 576 宗 減 少16.8%, 其 中 “ 祈 福 黨 ” 和 “ 借 錢 / 手 提 電 話 黨 ” 是 最 為 常 見 的 行 騙 手法 , 分 別 佔 街 頭 騙 案 總 數 的 44.3%(212 宗 ) 和 25.9%(124 宗 ) 。與 三 合 會 有 關 的 罪 案2.17 二 零 零 四 年 , 與 三 合 會 活 動 有 關 的 罪 案 佔 2.9%(2 346 宗 ) ,二 零 零 三 年 則 佔 2.8%(2 471 宗 )。 年 內 , 涉 及 三 合 會 的 罪 案 大 部 分 與 非法 會 社 罪 行 (727 宗 , 佔 31.0%), 傷 人 及 嚴 重 毆 打 (628 宗 , 佔 26.8%),以 及 勒 索 (274 宗 , 佔 11.7%) 有 關 。犯 罪 被 捕 的 青 少 年2.18 二 零 零 四 年 , 犯 罪 被 捕 的 少 年 ( 未 滿 16 歲 ) 有 4 897 人 , 較二 零 零 三 年 的 5 156 人 減 少 5.0%。 被 捕 少 年 干 犯 的 罪 行 大 多 為 店 舖 盜竊 (1 454 人 , 佔 29.7%)、 雜 項 盜 竊 (1 004 人 , 佔 20.5%), 以 及 傷 人 及嚴 重 毆 打 (664 人 , 佔 13.6%)。2.19 二 零 零 四 年 , 犯 罪 被 捕 的 青 年 (16 至 20 歲 ) 有 5 812 人 , 較二 零 零 三 年 的 6 018 人 減 少 3.4%。 被 捕 青 年 干 犯 的 罪 行 大 多 為 傷 人 及嚴 重 毆 打 (921 人 , 佔 15.8%)、 雜 項 盜 竊 (906 人 , 佔 15.6%)、 店 舖 盜 竊(640 人 , 佔 11.0%), 以 及 嚴 重 毒 品 罪 行 (460 人 , 佔 7.9%)。2.20 一 九 九 五 年 至 二 零 零 四 年 青 少 年 犯 罪 被 捕 人 數 的 圖 表 載 於附 錄 XIV。*****13
第 三 章二 零 零 四 年 撲 滅 罪 行 聯 席 會 議引 言3.1 撲 滅 罪 行 聯 席 會 議 每 兩 年 舉 行 一 次 , 目 的 是 喚 起 社 會 人 士對 滅 罪 工 作 的 關 注 , 加 強 撲 滅 罪 行 委 員 會 ( 委 員 會 ) 與 各 分 區 撲 滅 罪 行 委員 會 ( 分 區 滅 罪 會 ) 之 間 的 溝 通 , 交 流 滅 罪 意 見 。 首 屆 聯 席 會 議 在 一 九 八五 年 舉 行 , 本 年 的 聯 席 會 議 是 第 十 一 屆 。3.2 二 零 零 四 年 撲 滅 罪 行 聯 席 會 議 於 二 零 零 四 年 十 一 月 二 十 二日 在 伊 利 沙 伯 體 育 館 舉 行 。 大 會 主 題 為 “ 全 城 齊 滅 罪 人 人 樂 安居 ”, 強 調 社 會 各 界 同 心 合 力 打 擊 罪 行 是 滅 罪 關 鍵 所 在 。會 前 小 組 討 論3.3 在 聯 席 會 議 召 開 前 , 委 員 會 於 二 零 零 四 年 七 月 和 八 月 舉 行了 五 次 小 組 討 論 , 議 題 分 別 為 :• 爆 竊 與 家 居 保 安• 青 少 年 罪 行• 家 庭 暴 力• 商 業 及 科 技 罪 行• 跨 境 及 “ 搵 快 錢 ” 罪 行3.4 會 前 小 組 討 論 由 各 分 區 滅 罪 會 主 席 聯 合 主 持 , 並 邀 請 個 別範 疇 的 專 家 出 席 發 表 講 話 。 討 論 結 果 及 建 議 在 二 零 零 四 年 十 一 月 二 十二 日 聯 席 會 議 上 匯 報 。聯 席 會 議3.5 聯 席 會 議 由 陳 韻 雲 女 士 ,JP 主 持 , 出 席 者 超 過 400 人 , 包括 分 區 滅 罪 會 委 員 及 有 關 決 策 局 和 部 門 的 代 表 。 在 會 議 的 公 開 討 論 環節 , 決 策 局 及 部 門 高 級 官 員 組 成 答 問 團 , 回 應 與 會 者 提 出 的 意 見 及 建議 。 相 關 事 項 其 後 轉 介 有 關 決 策 局 / 部 門 研 究 及 跟 進 。 是 次 會 議 獲 傳媒 廣 泛 報 道 。主 要 議 題 的 跟 進 報 告3.6 就 分 區 滅 罪 會 對 以 上 五 個 罪 案 議 題 的 意 見 及 建 議 , 委 員 會備 悉 各 決 策 局 及 部 門 提 交 的 跟 進 報 告 如 下 :14
爆 竊 與 家 居 保 安民 政 事 務 總 署3.7 一 直 以 來 , 民 政 事 務 總 署 提 供 支 援 , 協 助 單 位 業 主 成 立 業主 立 案 法 團 ( 業 主 法 團 ), 以 便 有 效 管 理 大 廈 。 該 署 協 助 業 主 法 團 處 理 有關 大 廈 公 共 地 方 的 管 理 事 宜 , 包 括 .. 透 過 向 業 主 提 供 意 見 , 推 廣 保 安措 施 、 宣 傳 家 居 保 安 和 提 防 爆 竊 的 信 息 , 以 及 為 居 民 和 保 安 人 員 舉 辦研 討 會 和 培 訓 課 程 。房 屋 署3.8 房 屋 署 已 採 取 多 項 措 施 , 以 加 強 公 共 屋 的 保 安 。 這 些 措施 包 括 在 大 廈 加 強 監 察 、 在 警 方 的 協 助 下 突 擊 查 核 保 安 員 的 工 作 表現 , 加 密 巡 邏 黑 點 、 透 過 各 項 宣 傳 和 活 動 提 高 居 民 的 反 罪 案 意 識 , 以及 為 保 安 人 員 提 供 在 職 培 訓 。警 務 處3.9 政 府 多 個 部 門 攜 手 採 取 措 施 , 以 提 高 市 民 防 止 爆 竊 罪 案 的意 識 。 在 這 方 面 , 警 方 一 直 積 極 與 各 有 關 部 門 合 作 , 提 醒 市 民 注 意 家居 保 安 。青 少 年 罪 行(a)幫 助 青 少 年 建 立 自 信 、 掌 握 生 活 技 能 及 培 養 自 律 精 神 生 福 利 及 食 物 局 / 社 會 福 利 署3.10 為 幫 助 青 少 年 發 揮 潛 能 、 身 心 健 康 發 展 , 以 及 積 極 面 對 來自 家 庭 、 朋 輩 、 學 校 以 至 社 會 的 種 種 挑 戰 , 政 府 提 供 多 種 不 同 服 務 ,以 配 合 青 少 年 在 個 人 成 長 及 群 體 生 活 方 面 的 需 要 。 此 外 , 香 港 賽 馬 會慈 善 信 託 基 金 亦 撥 出 款 項 , 在 中 學 推 行 持 續 性 的 青 少 年 培 育 計 劃 , 以期 促 進 青 少 年 全 人 發 展 , 提 升 個 人 能 力 及 技 能 。(b)打 擊 青 少 年 濫 用 藥 物 問 題保 安 局 禁 毒 處3.11 政 府 會 繼 續 監 察 濫 用 藥 物 情 況 , 並 採 用 以 實 據 為 基 礎 的 模式 , 打 擊 濫 用 藥 物 問 題 。 當 局 會 向 負 責 青 少 年 預 防 或 康 復 服 務 的 專 業輔 導 員 和 禁 毒 工 作 者 提 供 禁 毒 處 各 項 研 究 的 結 果 , 並 會 通 過 傳 播 媒15

教 育 統 籌 局家 長 教 育3.22 教 育 統 籌 局 成 立 了 家 庭 與 學 校 合 作 事 宜 委 員 會 , 推 廣 家 長教 育 。 該 委 員 會 的 工 作 頗 見 成 效 , 包 括 鼓 勵 學 校 成 立 家 長 教 師 會 、 向家 長 宣 傳 各 項 服 務 、 為 家 長 教 師 會 幹 事 提 供 培 訓 及 為 家 長 舉 辦 專 題 講座 、 進 行 調 查 及 研 究 , 以 及 編 製 宣 傳 資 料 , 以 推 動 家 校 合 作 及 家 長 教育 。輔 導 服 務3.23 隨 小 學 學 生 輔 導 人 員 及 中 學 學 校 社 工 的 人 手 比 例 增 加 ,學 校 得 以 加 強 輔 導 服 務 , 並 改 善 發 展 及 預 防 方 面 的 工 作 , 以 防 止 學 生出 現 問 題 , 一 旦 出 現 問 題 , 亦 能 及 早 發 現 及 糾 正 。公 民 教 育3.24 在 本 港 , 學 校 課 程 的 整 體 目 標 之 一 , 是 教 導 學 生 認 識 他 們在 家 庭 、 社 會 及 國 家 應 負 的 義 務 和 責 任 , 以 及 關 心 家 人 、 社 會 和 國 家的 福 祉 。 因 此 , 公 民 教 育 是 學 校 課 程 不 可 或 缺 的 一 環 。 教 育 統 籌 局 透過 課 程 發 展 、 教 師 培 訓 、 資 源 支 援 及 學 生 活 動 等 多 方 面 的 工 作 , 推 廣公 民 教 育 。(e)保 護 少 數 族 裔 青 少 年 , 以 免 他 們 被 罪 犯 利 用 生 福 利 及 食 物 局 / 社 會 福 利 署3.25 為 應 付 少 數 族 裔 ( 主 要 是 南 亞 族 裔 ) 人 士 的 需 要 , 當 局 為 他 們提 供 的 服 務 重 建 立 社 區 網 絡 、 協 助 他 們 獲 得 社 區 資 源 和 社 會 服 務 、促 進 不 同 族 裔 之 間 以 及 少 數 族 裔 人 士 與 本 港 居 民 之 間 的 了 解 。教 育 統 籌 局3.26 教 育 統 籌 局 協 助 學 校 為 少 數 族 裔 兒 童 提 供 適 當 的 教 育 和 支援 , 以 及 預 防 少 數 族 裔 青 少 年 受 到 同 輩 中 不 良 份 子 影 響 或 參 與 罪 案 相關 活 動 。18
家 庭 暴 力(a)處 理 個 案 時 的 危 機 管 理 和 彈 性 生 福 利 及 食 物 局 / 社 會 福 利 署3.27 多 年 來 , 社 會 福 利 署 為 社 會 工 作 者 舉 辦 持 續 性 培 訓 課 程 ,其 中 一 個 目 的 是 提 升 他 們 在 風 險 評 估 、 危 機 介 入 和 個 案 管 理 其 他 方 面的 技 巧 。 社 會 福 利 署 會 繼 續 這 方 面 的 工 作 。 社 會 福 利 署 並 且 委 託 顧 問制 訂 一 套 風 險 評 估 工 具 , 供 前 線 專 業 人 員 應 用 。 有 關 的 研 究 正 在 進 行 。警 務 處3.28 警 方 認 為 , 在 處 理 家 庭 暴 力 個 案 時 , 除 採 用 科 學 方 法 外 ,亦 須 靈 活 行 事 及 就 實 際 情 況 作 出 專 業 判 斷 。 因 此 , 警 方 前 線 人 員 的 培訓 課 程 已 包 括 受 害 者 心 理 學 , 而 社 會 福 利 署 在 研 究 有 關 課 題 後 擬 定 的家 庭 暴 力 風 險 評 估 方 法 , 亦 會 納 入 相 關 的 警 察 培 訓 課 程 內 。(b)加 強 公 民 教 育 及 鄰 里 關 係民 政 事 務 局3.29 民 政 事 務 局 與 公 民 教 育 委 員 會 緊 密 合 作 , 在 校 外 推 廣 公 民教 育 。 公 民 教 育 委 員 會 舉 辦 的 多 項 宣 傳 及 教 育 活 動 , 均 以 宣 揚 家 庭 團結 及 社 會 和 諧 為 主 題 。3.30 此 外 , 民 政 事 務 總 署 亦 致 力 推 動 社 區 發 展 及 社 區 參 與 。 政府 會 透 過 民 政 事 務 局 / 民 政 事 務 總 署 在 社 區 的 深 厚 基 礎 及 強 大 的 聯 繫網 絡 , 繼 續 宣 揚 社 會 各 界 齊 參 與 的 精 神 , 以 及 加 強 市 民 與 政 府 之 間 的溝 通 。(c)評 估 及 跟 進 家 庭 暴 力 個 案 生 福 利 及 食 物 局 / 社 會 福 利 署3.31 社 會 福 利 署 已 委 託 機 構 研 究 虐 兒 和 虐 待 配 偶 問 題 , 研 究 結果 將 有 助 當 局 制 訂 有 效 措 施 , 處 理 家 庭 暴 力 問 題 。19
(d)按 各 區 需 要 調 撥 資 源 以 處 理 家 庭 暴 力 問 題 生 福 利 及 食 物 局 / 社 會 福 利 署3.32 社 會 福 利 署 致 力 透 過 服 務 重 整 , 提 高 家 庭 服 務 的 成 效 , 並透 過 重 新 調 配 資 源 , 增 設 一 個 保 護 家 庭 及 兒 童 服 務 課 。(e)設 立 家 庭 暴 力 個 案 中 央 資 料 庫 生 福 利 及 食 物 局 / 社 會 福 利 署3.33 政 府 認 為 , 如 設 立 中 央 資 料 庫 供 各 部 門 共 同 使 用 , 將 有 助不 同 界 別 的 人 員 合 力 預 防 和 處 理 家 庭 暴 力 問 題 。 為 此 , 社 會 福 利 署 已在 個 案 轉 介 程 序 上 與 警 方 加 強 聯 繫 , 並 會 繼 續 探 討 在 顧 及 私 隱 問 題 的情 況 下 , 有 關 各 方 可 否 交 換 更 多 個 案 資 料 。警 務 處3.34 由 二 零 零 五 年 三 月 起 , 警 方 設 立 了 家 庭 暴 力 資 料 庫 , 記 錄過 去 兩 年 舉 報 的 家 庭 暴 力 個 案 的 資 料 。 由 於 社 會 福 利 署 正 在 考 慮 設 立類 似 的 資 料 庫 以 監 察 家 庭 暴 力 個 案 , 警 方 會 研 究 稍 後 可 否 把 轄 下 的 資料 庫 與 社 會 福 利 署 的 資 料 庫 連 繫 。(f)有 關 家 庭 暴 力 問 題 的 宣 傳 工 作 生 福 利 及 食 物 局 / 社 會 福 利 署3.35 為 加 強 預 防 家 庭 暴 力 的 宣 傳 工 作 , 社 會 福 利 署 自 二 零 零 二至 零 三 年 度 起 在 全 港 展 開 宣 傳 運 動 , 宣 揚 加 強 家 庭 關 係 的 信 息 , 並 鼓勵 可 能 出 現 暴 力 問 題 的 家 庭 及 早 求 助 。 社 會 福 利 署 會 繼 續 這 方 面 的 工作 。警 務 處3.36 警 方 積 極 參 與 公 開 論 壇 和 研 討 會 , 提 醒 市 民 注 意 家 庭 暴 力問 題 的 嚴 重 性 。 警 方 會 繼 續 協 助 社 會 福 利 署 和 非 政 府 機 構 , 在 警 署 向市 民 派 發 有 關 家 庭 暴 力 問 題 的 宣 傳 單 張 。20
商 業 及 科 技 罪 行(a)警 務 處 、 教 育 統 籌 局 與 家 長 教 師 會 之 間 的 合 作教 育 統 籌 局3.37 教 育 統 籌 局 在 二 零 零 四 年 七 月 發 表 的 新 資 訊 科 技 教 育 策略 , 目 標 之 一 是 促 進 社 區 支 援 及 社 群 建 立 。 該 局 會 推 動 社 區 參 與 , 特別 是 家 長 的 參 與 , 鼓 勵 他 們 引 導 子 女 適 當 利 用 資 訊 科 技 , 以 及 清 楚 傳遞 有 關 網 上 操 守 的 信 息 。警 務 處3.38 警 方 與 教 育 統 籌 局 和 家 長 教 師 會 保 持 緊 密 的 工 作 關 係 , 透過 與 他 們 和 其 他 有 關 機 構 或 人 士 合 辦 活 動 , 鼓 勵 青 少 年 和 學 生 注 重 網上 操 守 。 警 方 亦 已 推 出 網 站 , 提 倡 網 上 操 守 。跨 境 和 “ 快 錢 ” 罪 行(a)透 過 警 方 宣 傳 計 劃 宣 揚 預 防 罪 案 信 息警 務 處3.39 警 方 會 繼 續 進 行 宣 傳 , 透 過 宣 傳 活 動 和 嘉 年 華 會 、 海 報 和單 張 , 以 及 在 邊 境 管 制 站 和 公 共 交 通 工 具 上 播 放 的 宣 傳 聲 帶 和 短 片等 , 提 醒 本 港 市 民 和 旅 客 預 防 跨 境 和 “ 快 錢 ” 罪 行 。(b)與 廣 東 和 澳 門 的 管 理 當 局 和 執 法 機 關 加 強 溝 通警 務 處3.40 警 方 與 廣 東 和 澳 門 的 執 法 機 關 經 常 交 換 情 報 , 合 作 調 查 個別 案 件 , 藉 以 保 持 有 效 的 溝 通 。 三 地 負 責 刑 事 調 查 的 主 管 每 兩 年 出 席論 壇 , 以 期 加 強 合 作 打 擊 各 項 跨 境 犯 罪 活 動 。 與 廣 東 和 澳 門 執 法 機 關的 緊 密 聯 繫 , 有 助 本 港 警 方 成 功 打 擊 賣 淫 場 所 、 拘 捕 懷 疑 內 地 妓 女 、賣 淫 和 外 圍 投 注 集 團 核 心 成 員 , 以 及 檢 獲 大 量 涉 嫌 犯 罪 得 益 和 足 球 賽投 注 單 。21
其 他 與 罪 案 相 關 的 事 項(a)延 長 賣 淫 場 所 的 封 閉 期警 務 處3.41 封 閉 賣 淫 場 所 無 疑 可 有 效 遏 止 賣 淫 活 動 , 但 警 方 認 為 , 由於 有 關 業 主 未 必 直 接 涉 及 賣 淫 活 動 , 現 時 封 閉 令 的 六 個 月 封 閉 期 , 已在 執 法 與 保 障 業 主 利 益 兩 者 之 間 取 得 平 衡 。 發 出 封 閉 令 只 是 打 擊 賣 淫活 動 的 措 施 之 一 。 除 執 行 封 閉 令 外 , 警 方 亦 致 力 根 據 情 報 採 取 行 動 及與 內 地 當 局 合 作 , 以 瓦 解 跨 境 賣 淫 集 團 。3.42 日 後 如 有 需 要 , 警 方 會 再 研 究 延 長 賣 淫 場 所 封 閉 期 的 問 題 。(b)合 併 西 貢 分 區 及 將 軍 澳 分 區 的 需 要警 務 處3.43 重 整 警 區 的 最 終 目 的 , 是 根 據 各 區 的 人 口 、 特 點 及 罪 案 情況 , 使 警 隊 服 務 更 完 善 , 警 隊 資 源 分 配 更 合 理 。 其 他 考 慮 因 素 包 括 可能 直 接 或 間 接 影 響 有 關 警 區 的 大 規 模 市 鎮 發 展 計 劃 及 基 建 工 程 項 目 。考 慮 到 上 述 因 素 , 目 前 沒 有 充 分 理 據 支 持 合 併 西 貢 分 區 及 將 軍 澳 分區 。 當 局 正 根 據 東 南 九 龍 ( 啟 德 舊 址 ) 重 建 計 劃 研 究 重 整 東 九 龍 總 區 各 警區 及 分 區 , 期 間 會 一 併 檢 討 這 個 問 題 。3.44 在 此 期 間 , 警 方 會 密 切 留 意 這 兩 個 分 區 的 情 況 , 有 需 要 時會 調 配 總 區 及 警 區 的 資 源 , 增 加 這 兩 個 分 區 的 警 力 。*****22

第 六 章二 零 零 四 至 零 五 年 度 助 更 生 宣 傳 運 動背 景6.1 更 生 人 士 能 否 重 新 融 入 社 會 , 成 為 奉 公 守 法 的 市 民 , 繫 於社 會 大 眾 的 接 納 與 支 持 。 為 此 , 懲 教 署 自 一 九 九 九 年 以 來 舉 辦 了 多 項宣 傳 活 動 , 讓 社 會 人 士 加 深 了 解 更 生 人 士 的 需 要 及 通 常 面 對 的 困 難 ,以 及 呼 籲 市 民 大 眾 給 予 支 持 。6.2 為 助 更 生 而 舉 辦 的 宣 傳 活 動 主 要 包 括 三 輯 電 視 實 況 劇 “ 鐵窗 邊 緣 ”、 電 視 宣 傳 短 片 和 電 台 宣 傳 聲 帶 、 更 生 人 士 就 業 研 討 會 、 電視 特 備 節 目 、 在 囚 人 士 文 娛 康 樂 才 藝 比 賽 、 綜 合 表 演 , 以 及 與 各 分 區撲 滅 罪 行 委 員 會 ( 分 區 滅 罪 會 ) 合 辦 的 社 區 參 與 活 動 。二 零 零 四 至 零 五 年 度 宣 傳 運 動∗6.3 懲 教 署 根 據 社 區 參 與 助 更 生 委 員 會 的 意 見 、 宣 傳 活 動 的 成效 和 該 署 過 往 的 經 驗 , 在 二 零 零 四 至 零 五 年 度 推 行 新 一 輪 宣 傳 活 動 ,對 象 為 四 個 社 ( 分 別 為 學 生 、 一 般 市 民 、 僱 主 及 地 區 組 織 ), 以 期 爭 取他 們 支 持 , 幫 助 更 生 人 士 重 新 融 入 社 會 。 除 分 區 滅 罪 會 外 , 懲 教 署 還邀 請 關 注 更 生 人 士 福 利 的 非 政 府 機 構 和 慈 善 組 織 與 該 署 攜 手 推 行 以 下的 宣 傳 及 公 眾 教 育 活 動 :(a)以 學 生 為 對 象 的 活 動• 在 分 區 滅 罪 會 支 持 下 , 懲 教 署 在 二 零 零 三 年 十 二 月 於 香港 會 議 展 覽 中 心 舉 辦 青 少 年 座 談 會 , 讓 中 學 生 與 更 生 人士 有 機 會 互 相 交 流 及 討 論 犯 罪 的 沉 重 代 價 。 其 後 , 該 署於 二 零 零 四 年 在 十 個 分 區 舉 辦 青 少 年 座 談 會 , 參 與 的 學生 每 次 約 有 150 人 , 由 區 內 的 學 校 和 青 少 年 團 體 提 名 。除 學 生 外 , 座 談 會 亦 邀 請 有 關 社 區 團 體 參 加 。 在 二 零 零五 年 , 懲 教 署 會 繼 續 在 其 他 地 區 舉 辦 同 類 活 動 , 在 全 港18 區 均 舉 辦 座 談 會 後 , 該 署 會 檢 討 這 項 活 動 的 成 效 。(b)以 一 般 市 民 為 對 象 的 活 動• 在 二 零 零 四 年 , 當 局 在 各 巴 士 站 和 電 車 站 張 貼 印 有 宣 傳標 語 的 新 海 報 。∗社 區 參 與 助 更 生 委 員 會 成 員 來 自 社 會 各 界 , 就 更 生 計 劃 及 協 助 更 生 人 士 重 新融 入 社 會 的 策 略 向 懲 教 署 署 長 提 供 意 見 。31
• 製 作 新 一 輯 的 電 視 宣 傳 短 片 和 電 台 宣 傳 聲 帶 , 在 二 零 零四 年 五 / 六 月 播 出 , 呼 籲 社 會 各 界 支 持 更 生 人 士 。• 第 三 輯 講 述 更 生 人 士 經 歷 的 電 視 實 況 劇 “ 鐵 窗 邊 緣 ” 在二 零 零 四 年 九 月 至 十 一 月 播 放 , 平 均 收 視 率 為 18%( 即 有120 萬 觀 眾 ) 。 正 如 先 後 在 二 零 零 零 年 和 二 零 零 二 年 播 放的 首 兩 輯 劇 集 一 樣 , 這 套 劇 集 亦 會 錄 製 成 數 碼 影 像 光碟 , 分 發 予 學 校 、 志 願 機 構 、 青 少 年 團 體 等 , 作 為 教 導和 輔 導 學 生 和 青 少 年 的 教 材 和 資 料 。• 製 作 有 關 更 生 服 務 的 短 片 , 然 後 把 短 片 上 載 懲 教 署 網站 , 供 公 眾 和 有 意 聘 用 更 生 人 士 的 僱 主 瀏 覽 , 使 他 們 進一 步 了 解 在 囚 人 士 在 懲 教 院 所 接 受 的 職 業 訓 練 和 更 生 計劃 。• 製 作 電 視 特 備 節 目 “ 仁 愛 更 生 獻 關 懷 ”, 於 二 零 零 四 年 十一 月 二 十 六 日 在 無 線 電 視 播 出 , 以 溫 和 的 手 法 鼓 勵 市 民接 納 更 生 人 士 。• 在 二 零 零 四 年 十 二 月 三 日 舉 辦 《 非 一 般 才 藝 薈 萃 》 綜 合晚 會 , 讓 在 囚 人 士 展 露 文 娛 康 樂 方 面 的 才 華 。 上 述 活 動除 可 鼓 勵 市 民 接 納 更 生 人 士 外 , 亦 凸 顯 了 與 非 政 府 機 構和 個 別 人 士 合 作 提 供 更 生 服 務 的 重 要 。(c)以 僱 主 為 對 象 的 活 動• 懲 教 署 與 香 港 大 學 犯 罪 學 中 心 在 二 零 零 四 年 三 月 合 辦 第三 屆 更 生 人 士 就 業 研 討 會 , 藉 以 引 起 僱 主 聘 用 更 生 人 士的 興 趣 。 透 過 與 本 地 工 商 機 構 合 作 , 研 討 會 有 400 人 參加 , 打 破 以 往 紀 錄 。• 懲 教 署 繼 續 安 排 有 意 聘 用 更 生 人 士 的 僱 主 參 觀 轄 下 院所 , 使 他 們 進 一 步 認 識 該 署 的 更 生 服 務 和 計 劃 , 特 別 是懲 教 院 所 為 在 囚 人 士 提 供 的 職 業 訓 練 和 技 能 訓 練 。(d)以 地 區 組 織 為 對 象 的 活 動• 由 二 零 零 一 至 零 二 年 度 開 始 , 分 區 滅 罪 會 與 懲 教 署 合 辦更 生 宣 傳 活 動 。 有 關 活 動 包 括 探 訪 懲 教 院 所 、 展 覽 、 與在 囚 人 士 交 流 經 驗 、 綜 合 表 演 和 義 務 工 作 。• 由 於 合 作 成 績 理 想 , 在 二 零 零 四 年 六 月 懲 教 署 舉 行 的 簡報 會 上 , 各 分 區 滅 罪 會 表 示 支 持 繼 續 舉 辦 有 關 活 動 。 懲教 署 已 委 派 地 區 聯 絡 主 任 統 籌 這 些 地 區 宣 傳 活 動 。32
6.4 二 零 零 四 至 零 五 年 度 已 推 行 或 計 劃 推 行 的 活 動 , 除 了 上 述各 項 主 要 宣 傳 和 公 眾 教 育 活 動 外 , 還 包 括 以 下 各 項 : 在 二 零 零 四 年 十一 月 六 日 懲 教 署 秋 季 賣 物 會 舉 行 的 特 別 綜 合 表 演 、 在 政 府 帳 單 印 上 宣傳 標 語 , 以 及 在 二 零 零 四 年 十 月 委 任 知 名 藝 人 劉 德 華 先 生 為 更 生 大使 , 協 助 呼 籲 社 會 大 眾 支 持 更 生 人 士 。 懲 教 署 在 二 零 零 四 年 年 初 成 立的 懲 教 更 生 義 工 團 , 主 要 成 員 為 教 師 和 大 學 生 , 義 工 團 協 助 和 指 導 在囚 人 士 , 並 支 援 宣 傳 運 動 。 該 署 會 繼 續 聯 絡 崇 德 社 、 獅 子 會 、 扶 輪 社 、關 顧 更 生 人 士 會 等 社 區 組 織 , 請 他 們 義 務 提 供 協 助 和 專 業 知 識 , 以 便為 在 囚 人 士 舉 辦 興 趣 班 和 技 能 訓 練 。未 來 發 展6.5 更 生 人 士 能 否 改 過 自 新 , 成 為 奉 公 守 法 的 市 民 , 社 會 人 士的 支 持 是 一 大 關 鍵 。 更 生 人 士 自 新 , 有 助 減 低 再 犯 罪 率 , 節 省 公 共 開支 。 懲 教 署 會 繼 續 舉 辦 公 眾 教 育 活 動 , 推 動 社 會 接 納 更 生 人 士 , 呼 籲市 民 協 助 更 生 人 士 重 新 融 入 社 會 。*****33
第 七 章警 司 警 誡 計 劃 的 進 展背 景7.1 根 據 警 司 警 誡 計 劃 , 警 司 或 以 上 職 級 的 警 務 人 員 可 以 酌 情警 誡 青 少 年 罪 犯 , 代 替 提 出 刑 事 檢 控 。 自 一 九 九 五 年 九 月 一 日 起 , 合資 格 接 受 警 誡 的 青 少 年 罪 犯 的 年 齡 上 限 由 未 滿 17 歲 提 高 至 未 滿 18歲 , 使 更 多 青 少 年 罪 犯 可 以 得 到 接 受 警 誡 的 機 會 。 撲 滅 罪 行 委 員 會 ( 委員 會 ) 透 過 警 務 處 處 長 每 半 年 提 交 的 進 度 報 告 , 監 察 這 項 計 劃 的 進 展 。整 體 情 況7.2 二 零 零 四 年 , 因 觸 犯 各 種 刑 事 罪 行 而 被 捕 的 青 少 年 ( 在 本 報告 內 , 青 少 年 指 未 滿 18 歲 的 人 士 ) 共 有 7 566 人 , 較 二 零 零 二 年 (8 156人 ) 及 二 零 零 三 年∗ (7 918 人 ) 分 別 減 少 7.2% 及 4.4%。 年 內 青 少 年 罪 犯 最常 觸 犯 的 五 種 刑 事 罪 行 是 店 舖 盜 竊 、 雜 項 盜 竊 、 傷 人 及 嚴 重 毆 打 、 行劫 , 以 及 妨 礙 公 安 罪 行 ( 見 附 錄 XVI 的 圖 表 )。7.3 並 非 所 有 被 捕 的 青 少 年 均 可 接 受 警 誡 。 二 零 零 四 年 , 被 捕的 青 少 年 中 只 有 51.9% 合 資 格 接 受 警 誡 , 二 零 零 二 年 及 二 零 零 三 年 則分 別 有 54.7% 及 50.4%。 在 評 核 青 少 年 罪 犯 是 否 合 資 格 接 受 警 誡 時 , 仍沿 用 以 下 指 引 ..(a) 罪 犯 在 接 受 警 誡 時 必 須 未 滿 18 歲 ;(b) 罪 犯 以 往 並 無 刑 事 犯 罪 紀 錄 ;(c) 所 掌 握 的 證 據 足 以 提 出 起 訴 ;(d)罪 犯 自 願 而 明 確 地 承 認 控 罪 ; 以 及(e) 罪 犯 及 其 家 長 或 監 護 人 同 意 罪 犯 接 受 警 誡 。7.4 二 零 零 四 年 , 共 有 2 929 名 青 少 年 罪 犯 接 受 警 誡 , 較 二 零 零二 年 (3 345 人 ) 及 二 零 零 三 年 (3 012 人 ) 分 別 減 少 12.4% 和 2.8%。 年 內 接受 警 誡 的 人 數 佔 被 捕 青 少 年 罪 犯 的 38.7%, 二 零 零 二 年 及 二 零 零 三 年則 分 別 佔 41.0% 及 38.0%。 二 零 零 二 至 二 零 零 四 年 期 間 接 受 警 誡 的 青 少年 罪 犯 人 數 比 較 如 下 ..∗由 二 零 零 三 年 七 月 一 日 , 刑 事 責 任 的 最 低 年 齡 由 七 歲 提 高 至 十 歲 。34

7.9 保 護 組 與 社 會 福 利 署 和 教 育 統 籌 局 經 常 保 持 聯 繫 , 並 就 青少 年 的 家 庭 問 題 徵 詢 該 兩 個 部 門 / 局 的 意 見 。 保 護 組 也 會 視 乎 情 況 ,轉 介 受 監 管 的 青 少 年 參 加 社 區 支 援 服 務 計 劃 、 少 年 警 訊 、 香 港 青 年 獎勵 計 劃 或 其 他 機 構 接 受 跟 進 服 務 。7.10 自 一 九 九 七 年 年 中 以 來 , 經 警 方 轉 介 參 加 社 區 支 援 服 務 計劃 的 青 少 年 , 人 數 不 斷 上 升 。 警 方 有 時 會 安 排 青 少 年 參 與 計 劃 而 毋 須接 受 保 護 組 監 管 , 有 時 則 會 安 排 青 少 年 同 時 接 受 監 管 及 參 與 計 劃 。 社區 支 援 服 務 計 劃 的 目 的 , 是 引 導 曾 犯 法 的 青 少 年 走 上 正 途 , 過 循 規 蹈矩 的 生 活 。 計 劃 內 容 包 括 :(a) 輔 導 或 支 援 小 組 ;(b) 職 業 訓 練 和 就 業 輔 導 ;(c) 技 巧 學 習 班 ;(d) 野 外 探 險 活 動 ;(e)志 願 及 社 區 服 務 計 劃 ; 以 及(f) 為 家 長 或 監 護 人 舉 辦 的 活 動 。再 次 犯 案7.11 罪 犯 如 在 接 受 警 誡 之 日 起 計 兩 年 內 或 在 年 滿 18 歲 之 前 ( 兩者 以 較 早 者 為 準 ) 因 犯 罪 而 再 次 被 捕 , 即 被 視 為 再 次 犯 案 。 二 零 零 二 年接 受 警 誡 的 青 少 年 再 次 犯 案 的 比 率 是 17.7%, 而 二 零 零 零 年 及 二 零 零一 年 的 比 率 分 別 是 18.0% 及 18.9%。 鑑 於 計 算 期 為 兩 年 , 故 暫 時 未 有 二零 零 三 年 及 以 後 的 數 字 。未 來 路 向7.12 委 員 會 會 繼 續 透 過 警 務 處 處 長 每 半 年 提 交 的 進 度 報 告 , 監察 警 司 警 誡 計 劃 的 進 展 , 並 會 建 議 採 取 適 當 的 跟 進 行 動 。*****36
第 八 章撲 滅 罪 行 宣 傳 策 略背 景8.1 宣 傳 小 組 委 員 會 ( 小 組 委 員 會 ) 為 每 年 初 夏 展 開 的 撲 滅 罪行 宣 傳 運 動 制 定 策 略 。 宣 傳 運 動 通 常 設 有 一 至 數 個 主 題 , 針 對 常 見 的罪 案 及 / 或 公 眾 關 注 的 問 題 。 有 關 策 略 獲 得 撲 滅 罪 行 委 員 會 通 過 後 ,即 由 小 組 委 員 會 負 責 推 行 。二 零 零 三 至 零 四 年 度 宣 傳 運 動 檢 討8.2 二 零 零 三 至 零 四 年 度 撲 滅 罪 行 宣 傳 運 動 是 重 點 宣 傳 項 目 ,獲 撥 經 費 一 百 六 十 萬 港 元 。8.3 宣 傳 運 動 首 個 主 題 為 防 止 街 頭 騙 案 , 有 關 宣 傳 口 號 為 「 小心 街 頭 騙 案 」。 小 組 委 員 會 於 二 零 零 二 年 與 香 港 電 台 攜 手 合 作 , 推 出 受歡 迎 的 「 香 江 暖 流 ─ 街 頭 騙 案 實 錄 」 電 台 節 目 , 呼 籲 長 者 提 防 不 法之 徒 藉 詞 買 賣 電 子 零 件 和 藥 物 , 以 及 「 作 福 消 災 」 等 手 法 行 騙 。8.4 鑑 於 電 台 節 目 收 效 理 想 , 小 組 委 員 會 再 接 再 厲 , 於 二 零 零三 至 零 四 年 度 與 香 港 電 台 合 作 攝 製 「 都 市 陷 阱 」 電 視 短 劇 。 該 套 短 劇共 有 八 輯 , 旨 在 揭 露 不 法 之 徒 所 使 用 的 各 種 行 騙 手 段 。「 尼 爾 森 媒 介 」的 資 料 顯 示 , 每 一 輯 「 都 市 陷 阱 」 短 劇 皆 吸 引 一 百 三 十 多 萬 名 四 歲 以上 的 觀 眾 收 看 , 足 見 其 受 歡 迎 程 度 。 其 後 , 小 組 委 員 會 更 將 該 套 短 劇錄 製 成 光 碟 , 派 發 予 社 區 中 心 和 長 者 中 心 等 。8.5 此 外 , 小 組 委 員 會 同 時 推 出 電 視 宣 傳 短 片 、 電 台 宣 傳 聲 帶 、海 報 和 報 章 廣 告 及 戶 外 媒 體 廣 告 等 , 進 一 步 呼 籲 市 民 提 防 騙 徒 。8.6 由 於 扒 竊 等 「 搵 快 錢 」 罪 案 數 字 於 二 零 零 三 年 頭 數 個 月 錄得 頗 大 升 幅 , 小 組 委 員 會 將 防 止 雜 項 盜 竊 訂 為 宣 傳 運 動 下 半 年 的 主題 , 並 於 十 月 底 推 出 一 系 列 以 「 謹 慎 每 秒 鐘 財 物 免 失 蹤 」 為 口 號 的宣 傳 物 品 , 提 醒 市 民 時 刻 看 管 自 己 的 財 物 , 以 免 匪 徒 有 機 可 乘 。二 零 零 四 至 零 五 年 度 宣 傳 運 動 策 略8.7 二 零 零 四 至 零 五 年 度 撲 滅 罪 行 宣 傳 運 動 繼 續 備 受 重 視 , 獲撥 經 費 一 百 六 十 萬 港 元 。37
8.8 在 過 去 數 年 的 撲 滅 罪 行 宣 傳 運 動 曾 先 後 以 青 少 年 罪 行 、 電腦 罪 案 、 店 舖 盜 竊 、 爆 竊 、 街 頭 騙 案 及 雜 項 盜 竊 等 較 常 見 的 罪 行 為 主題 , 所 製 作 的 宣 傳 品 仍 可 在 有 需 要 時 配 合 當 時 的 罪 案 情 況 , 再 度 推 出 。故 此 , 二 零 零 四 至 零 五 年 度 宣 傳 運 動 採 取 一 個 與 以 往 不 同 的 宣 傳 策 略 。8.9 委 員 會 採 納 以 「 協 助 警 方 撲 滅 罪 行 」 為 主 題 , 提 醒 市 民 他們 在 打 撃 罪 行 方 面 扮 演 十 分 重 要 的 角 色 。 市 民 所 給 予 警 方 的 支 持 和 合作 , 簡 單 如 打 電 話 向 警 方 提 供 資 料 , 有 助 防 止 及 偵 破 罪 案 。8.10 宣 傳 運 動 第 一 期 在 二 零 零 四 年 六 月 開 展 。 透 過 一 系 列 宣 傳活 動 , 提 醒 市 民 要 保 持 警 覺 , 提 防 罪 案 , 並 且 善 用 自 己 的 裝 備 - 就是 眼 、 耳 、 口 和 手 , 向 警 方 舉 報 罪 案 , 合 力 打 撃 罪 惡 。8.11 第 二 期 的 宣 傳 運 動 則 在 二 零 零 四 年 十 二 月 推 出 , 沿 用 第 一期 宣 傳 運 動 的 主 題 , 提 醒 市 民 利 用 本 身 的 裝 備 , 令 罪 案 曝 光 。8.12 整 個 運 動 共 製 作 了 兩 套 電 視 宣 傳 短 片 , 以 及 兩 套 電 台 宣 傳聲 帶 、 海 報 、 巴 士 車 身 廣 告 及 其 他 戶 外 電 子 媒 體 廣 告 。 兩 套 電 視 宣 傳短 片 更 上 載 至 香 港 特 別 行 政 區 政 府 網 頁 - 政 府 資 訊 中 心 。8.13 在 地 區 層 面 上 , 各 分 區 撲 滅 罪 行 委 員 會 、 少 年 警 訊 以 及 警方 亦 在 年 內 繼 續 緊 密 合 作 , 舉 辦 各 種 配 合 宣 傳 運 動 主 題 的 活 動 , 將 有關 信 息 傳 遞 予 社 會 各 階 層 人 士 。*****38

CHAPTER 1INTRODUCTIONBACKGROUND1.1 In March 1973, the Government set up the Fight Violent CrimeCommittee to tackle the problem of the rising trend of crime since the early1970s. The Committee was chaired by the then Secretary for Home Affairsand comprised only official members. Its terms of reference were to plan,organise and co-ordinate Government and public efforts to assist the Police tocombat violent crime. In 1975, the Fight Violent Crime Committee wasrenamed the Fight Crime Committee (FCC) with its membership expanded toinclude non-official members.1.2 In May 1983, the FCC was reconstituted with the then ChiefSecretary as its new Chairman. It was tasked to draw up plans to reduce crime,to co-ordinate efforts in fighting crime, to monitor the results and to reportprogress to the then Governor. The reconstituted Committee submitted its firstreport to the then Governor in December 1983.1.3 This is the twenty-fourth report of the Committee, and it details thework undertaken by the Committee for the calendar year 2004.FIGHT CRIME COMMITTEE AND ITS SUB-COMMITTEES1.4 The FCC consists of 16 members: eight are members of the publicappointed by the Chief Secretary for Administration and eight are heads ofrelevant government policy bureaux and departments. The Committee’s termsof reference and membership list are at Appendix I(a) & 1(b). There are twosub-committees under the FCC -• Standing Committee on Young Offenders• Publicity Sub-CommitteeDetails of terms of reference and the membership list of the sub-committees areat Appendix II(a) & II(b).MAJOR ISSUES CONSIDERED1.5 In 2004, the FCC held a total of five meetings. Apart fromexamining the overall crime situation as well as that of commercial crimes,91
monitoring progress of the Police Superintendents’ Discretion Scheme,implementing the fight crime publicity work and overseeing the work of DistrictFight Crime Committees (DFCCs), the Committee also discussed the newinitiatives on offenders’ rehabilitation programmes taken forward by theCorrectional Services Department.DISTRICT FIGHT CRIME COMMITTEES1.6 DFCCs are established in the 18 districts of the territory. Thesecommittees, which comprise official and non-official members, play animportant part in promoting the fight against crime and in encouraging publicparticipation at district level. They have cross-membership with DistrictCouncils and are the only committees that are directly concerned with law andorder issues in each of the districts. The terms of reference and membershiplists of the DFCCs are at Appendix III(a) & III(b). The report on the work ofDFCCs is in Chapter 9.*****92
GENERAL CRIME SITUATIONCHAPTER 2CRIME SITUATION IN 20042.1 There were 81 315 crimes reported to the Police in 2004, a decreaseof 8.0% compared with 88 377 recorded in 2003. The crime rate, which isdefined as the number of reported crimes per 100 000 population, was 1 181.5, adrop of 9.1% compared with 1 299.1 in 2003. The overall crime detection ratein 2004 was 43.6%, compared with 39.2% in 2003.2.2 A chart showing the figures of reported cases, crime rates anddetection rates of overall crime from 1995 to 2004 is at Appendix IV.VIOLENT CRIME2.3 The total number of violent crimes (which include homicide, rape,indecent assault, wounding, serious assault, robbery, kidnapping, blackmail,criminal intimidation, and arson) recorded in 2004 was 13 890, a decrease of4.5% compared with 14 542 in 2003. The drop in violent crime was mainlyascribed to decreases in robbery, wounding, and blackmail. The violent crimerate per 100 000 population was 201.8, a drop of 5.6% compared with 213.8 in2003. The violent crime detection rate in 2004 was 57.4%, compared with52.4% in 2003.2.4 A chart showing the figures of reported cases, crime rates anddetection rates of violent crime from 1995 to 2004 is at Appendix V.ANALYSES OF SELECTED CRIMESRobbery2.5 There were 2 237 robberies recorded in 2004, a drop of 30.4%compared with 3 215 in 2003 (see chart at Appendix VI).2.6 There were 3 robberies involving the use of genuine firearms in2004, while there was no such case in 2003. There were 7 cases of robberywith stun guns and 47 cases of robbery with pistol-like objects, compared with 4and 44 in 2003 respectively (see chart at Appendix VII).93
2.7 The number of bank robbery cases was 16 in 2004, compared with34 in 2003. There were 6 cases of goldsmith/watch shop robbery in 2004, adrop of 3 cases compared with 9 cases in 2003. The statistics on bank andgoldsmith/watch shop robberies from 1995 to 2004 are at Appendix VIII.Burglary2.8 There were 7 002 burglaries in 2004, a drop of 22.9% comparedwith 9 076 in 2003 (see chart at Appendix IX).Homicide2.9 There were 45 homicide cases in 2004, compared with 52 in 2003(see chart at Appendix X). Among the 45 cases in 2004, 20 cases (44.4%)were domestic in nature. The figure was 17 (32.7%) in 2003. There were 9cases in which 9 children aged 12 or below were killed by their parents in 2004,compared with 7 in 2003.Wounding and Serious Assault2.10 The number of wounding and serious assault cases rose by 0.2%from 7 147 in 2003 to 7 161 in 2004 (see chart at Appendix XI). Some 8.8%of the wounding and serious assault cases in 2004 were triad related, comparedwith 9.1% in 2003.Serious Narcotics Offences2.11 There were 2 167 serious narcotics offences (e.g. trafficking in,manufacturing and possession of dangerous drugs) recorded in 2004, an increaseof 1.2% compared with 2 142 in 2003. Altogether 2 712 persons were arrestedfor serious narcotics offences in 2004, a decrease of 1.2% compared with 2 746in 2003. The arrest of juveniles and young persons aged under 21 years oldrose by 9.9% from 454 persons in 2003 to 499 persons in 2004. Among thesejuveniles and young persons, 455 persons (91.2%) were arrested in connectionwith psychotropic drugs.Shop Theft2.12 The number of shop thefts reported to the Police was 9 186, adecrease of 1.3% compared with 9 304 in 2003 (see chart at Appendix XII).The value of the stolen property was HK$ 200 or below in 6 368 cases (69.3%).94
Motor Vehicles Reported Missing2.13 There were 1 740 motor vehicles reported missing in 2004, adecrease of 24.4% compared with 2 301 in 2003 (see chart at Appendix XIII).2.14 The number of cases involving luxury cars (Mercedes Benz,B.M.W., Lexus and Toyota Crown) dropped to 60, a decrease of 33.3%compared with 90 in 2003. The number of reports involving jeeps decreasedfrom 108 in 2003 to 23 in 2004, down by 78.7%. The number of reportsinvolving high performance vehicles decreased from 158 in 2003 to 43 in 2004,down by 72.8%. The stealing of container tractors dropped to 47 comparedwith 100 in 2003, a decrease of 53.0%.2.15 The overall recovery rate of missing motor vehicles in 2004 was48.0%, compared with 55.2% in 2003.Street Deception2.16 There were 479 street deception cases in 2004, a drop of 16.8%compared with 576 in 2003. “Spiritual Treatment” and “BorrowMoney/Mobile Phones” represented the most prevalent types of such crime,accounting for 44.3% (212 cases) and 25.9% (124 cases) of all street deceptioncases in 2004.Triad Related Crimes2.17 The proportion of crimes attributable to triad activity was 2.9%(2 346 cases) in 2004 and 2.8% (2 471 cases) in 2003. In 2004, most of thesecrimes were related to offences such as unlawful society offences (727 cases or31.0%), wounding and serious assault (628 cases or 26.8%), and blackmail (274cases or 11.7%).JUVENILES AND YOUNG PERSONS ARRESTED FOR CRIME2.18 The number of juveniles (aged under 16) arrested for crime in 2004was 4 897, a drop of 5.0% compared with 5 156 persons in 2003. Most ofthem were arrested for shop theft (1 454 persons or 29.7%), miscellaneous thefts(1 004 persons or 20.5%), and wounding and serious assault (664 persons or13.6%).95
2.19 The number of young persons (aged between 16 and 20) arrestedfor crime in 2004 was 5 812, a drop of 3.4% compared with 6 018 persons in2003. Most of them were arrested for wounding and serious assault (921persons or 15.8%), miscellaneous thefts (906 persons or 15.6%), and shop theft(640 persons or 11.0%), and serious narcotics offences (460 persons or 7.9%).2.20 A chart showing the arrests of juveniles and young persons forcrime from 1995 to 2004 is at Appendix XIV.*****96
CHAPTER 32004 FIGHT CRIME CONFERENCEINTRODUCTION3.1 The Fight Crime Conference is a biennial event to fostercommunity interest in fight crime matters, to reinforce communicationsbetween the Fight Crime Committee (FCC) and District Fight CrimeCommittees (DFCCs) and to provide a forum for exchange of views on ways toreduce crime. The 2004 Fight Crime Conference is the eleventh of its kindbeing held since 1985.3.2 The 2004 Fight Crime Conference was held on 22 November 2004at the Queen Elizabeth Stadium. The theme was “ A Safer City, A BetterPlace”, highlighting the importance of united efforts of all parties in the fightagainst crime.PRE-CONFERENCE GROUP DISCUSSIONS3.3 Prior to the Conference, five group discussions were held in themonths of July and August 2004. Topics discussed were –• Burglary and Home Security• Youth Crime• Family Violence• Commercial and Technology Crimes• Cross-boundary and Quick Cash Crimes3.4 These pre-Conference group discussions were co-chaired byDFCC Chairmen. Experts on specific subjects were invited to speak duringthe discussions. The findings and recommendations of the five discussiongroups were reported at the main Conference on 22 November 2004.THE MAIN CONFERENCE3.5 The main Conference, which was chaired by Ms Vivien Chan, JP,was attended by over 400 participants including DFCC members andrepresentatives of relevant policy bureaux and departments. During the openforum at the Plenary Session, a panel consisting of senior officials from bureauxand departments was formed to respond to views and suggestions made by theparticipants. Relevant issues were subsequently referred to responsible policybureaux and departments for consideration and follow-up actions. The97
Conference was well covered by the media.FOLLOW-UP REPORT ON MAJOR ISSUES RAISED3.6 The FCC noted the follow-up report on views and suggestionsmade by DFCCs on crime issues relating to the above five topics as follows.Burglary and Home SecurityHome Affairs Department (HAD)3.7 HAD has long been providing support to flat owners in formingowners’ corporations (OCs) to facilitate effective building management. Itassists OCs in handling matters relating to the management of the commonparts of the building including, among other things, promotion of securityarrangements through giving advice to owners, publicizing of home securityand burglary prevention messages and conducting seminars and training coursesfor both residents and security personnel.Housing Department (HD)3.8 HD has adopted a number of measures to step up security controlin public housing estates. These included the implementation of an enhancedmonitoring mechanism in buildings, carrying out surprise checks on theperformance of security guards with the Police’s assistance, strengtheningpatrol to black spots, as well as promoting anti-crime awareness of the residentsthrough various publicity measures, activities and on-the-job training forsecurity personnel.The Police3.9 With regard to inter-departmental co-operation in the promotion ofthe public’s anti-burglary awareness, the Police have been active incollaborating with the departments concerned to enhance public awareness onhome security.Youth Crime(a) fostering the youth’s self-confidence and enhancing their living skills andsense of discipline98
Health, Welfare and Food Bureau (HWFB)/Social Welfare Department (SWD)3.10 With the objectives of developing the potential of the youth,facilitating their healthy development and assisting them in facing thechallenges from their family, peers, school and the society, the Government hasput in place a variety of services catering for the socialization anddevelopmental needs of the young people. Funds have also been approved bythe Hong Kong Jockey Club Charities Trust to implement a multi-year youthproject at secondary schools, with a view to promoting the holistic developmentof the youth in terms of competence and skills.(b) combating drug abuse among the youthNarcotics Division (ND) of Security Bureau3.11 The Government will continue to monitor the drug abuse situationand tackle the drug abuse problem under an evidence-based approach.Findings of studies will be disseminated to professional counsellors andanti-drug workers who provide preventive or rehabilitation services to theyoung people, and the community as a whole through the media. ND willpursue its efforts in educating the students, the youth and the public on theprevention of drug abuse through the newly opened Hong Kong Jockey ClubDrug InfoCentre and the preventive education programmes.Education and Manpower Bureau (EMB)3.12 On the educational side, EMB has strengthened its efforts againstdrug abuse by means of incorporating drug education topics in the schoolcurriculum and providing enhancement programmes for principals and teachersin primary and secondary schools. These programmes include drug educationcourses conducted by the Chinese University of Hong Kong and seminars cumvisits to the Hong Kong Jockey Club Drug InfoCentre organized jointly withND. EMB also provides teachers with the relevant drug education resourcesand sponsors the Life Education Activity Programme to help primary pupils todevelop positive values and attitudes early in life.99
Health, Welfare and Food Bureau (HWFB)/Social Welfare Department (SWD)3.13 With the aim of helping young drug abusers abstain fromdrug-taking habits and reintegrate them into the community, SWD adopts amulti-modality approach in providing drug treatment and rehabilitation servicesthrough both community-based and residential services by means of counselling,group activities, prevocational and social skills training. Under the policy leadof ND, SWD collaborates with departments concerned including the Police andthe Customs and Excise Department (C&ED) to combat drug abuse.The Police3.14 Listing drug abuse among the youth as one of their OperationalTargets in 2005, the Police will step up their efforts to tackle the drug abuseproblem, in terms of preventive measures, anti-drug operations, recovery ofproceeds to disrupt trafficking activities and publicity and education initiatives.(c) strengthening collaboration among government departments/ bureauxwith a view to combating youth crimes and providing appropriate servicesto the youth-at-riskHWFB/SWD3.15 The “Committee on Services for Youth at Risk”, chaired by theDirector of Social Welfare and comprising representatives from EMB, SWD,the Department of Health and the Police, has been in operation through regularmeetings to tackle the youth crime problem at the policy level. At the districtlevel, the local youth service committees operating in a cross-sector andcross-district mode had been set up by SWD to formulate services tailored tothe needs of young people, as well as to coordinate various efforts in bringingdown the number of youth crime cases. On the implementation of workprogrammes, EMB and SWD have worked together to organize a number ofprojects for the prevention of juvenile delinquency, such as the provision of“early identification and intervention” service with the help of schools andnon-governmental social service organizations. Meanwhile, theUnderstanding Adolescent Project has been launched in all secondary schools toenable early identification of students in need of special support and to providethem with comprehensive developmental support and training.3.16 In addition, SWD has engaged in a number of joint endeavourswith other government departments in addressing the youth’s needs. Thesemeasures included the introduction of the Family Conference for juveniles100
cautioned under the Police Superintendents’ Discretion Scheme, establishmentof a referral mechanism for Police’s referral of needy children below the age of10 to the appropriate welfare services, and referral systems of welfare servicesand youth services respectively. Sports Centres and other recreationalfacilities of LCSD have also been opened up at late night and programmes havebeen organized for the youth-at-risk.3.17 To cater for the employment needs of the young people, SWD alsoprovides career guidance services and operates employment projects through itswelfare services units.EMB3.18 Through civic education and moral programmes, the departmentsconcerned have endeavoured to instil into the students positive civic values.Besides, the Police and the schools have jointly organized the “School LiaisonOfficer Scheme” through which schools might seek assistance or advice fromthe school liaison officers in dealing with serious behavioural problems ofstudents. Large-scale seminars are also held by EMB each year to facilitatethe exchange of views among school liaison officers, the parties concerned andschool disciplinary teachers in an endeavour to explore ways of handlingbehavioural problems of students. Furthermore, the “Smart Teen ChallengeProject” jointly organized by EMB and the Police has been in place since 2000to provide the youth with disciplinary training, as well as to help them perceivethe adverse impact of criminal behaviour.The Police3.19 As far as educational and promotional efforts are concerned, eachpolice division will organize youth activities suited to its local circumstances,while the divisional commanders will also deploy resources for organizingactivities tailored for the youth of their respective regions. As regardsenforcement actions, the divisional commanders will collect information onjuvenile delinquency among school students through the relevant school liaisonofficers, so as to work out specific solutions for the identified problems. Thedistrict anti-triad squads will also step up the patrol of black spots of triadactivities with reference to the level of triad disturbance. At the central level,the Police Headquarters will closely monitor the situation of juveniledelinquency and will formulate policies to curb the problem once a rising trendin youth crime has surfaced.3.20 In addition to the joint efforts with bureaux/departments concernedon combating youth crime mentioned above, the Police have coordinated over101
50 initiatives at the district level under a multi-agency approach.(d) injection of additional resources into implementing parent education,counselling and civic educationHWFB/SWD3.21 Apart from the core services for the young people, SWD alsoprovides parent education and counselling services as well as group andcommunity activities catering for the needs of both the young people and theirparents. New recurrent resources will be allocated to strengthen support forthe youth-at-risk and young offenders as well as to provide assistance to thedeprived children and youth to promote their development and integration intothe community. In particular, the new resources to be made available for theservices for Young Night Drifters and the Community Support Services Schemewill enhance their capacity to address the changing needs of the youth-at-riskand young offenders, including the need for parent education and counsellingon various developmental issues and the cultivation of positive civic values.EMBParent education3.22 EMB has set up the Committee on Home-School Co-operation(CHSC) for the promotion of parent education. The Committee has beensuccessful in encouraging the setting up of parent-teacher associations (PTAs)in schools, publicizing services available to the parents, providing training forPTA executives and thematic talks for parents, conducting surveys andresearches and producing publicity materials to promote home schoolco-operation and parent education.Counselling3.23 With the improved manning ratios of student guidance personnel inprimary schools and school social workers in secondary schools, morecounselling, developmental and preventive work have been carried out inschools to prevent, detect and rectify the students’ problems.Civic education3.24 One of the overall aims of the school curriculum of Hong Kong isthat students should be able to recognize their roles and responsibilities asmembers in the family, the society, and the nation, and show concern for their102
well-being. The promotion of civic education is thus essential in the schoolcurriculum. EMB has been promoting civic education through variousinitiatives in the areas of curriculum development, training for teachers,resources support and students’ activities.(e) protecting the youth of the ethnic minority against exploitation by theculpritsHWFB/SWD3.25 In addressing the needs of the ethnic minority, mainly from SouthAsia, services for this target group are focused on building up the socialnetwork among them and assisting them in gaining access to communityresources and social services as well as fostering better understanding amongpeople of different racial origins and between ethnic minorities and localresidents.EMB3.26 EMB has assisted schools to provide adequate education andsupport for children of the ethnic minority, and to prevent the youth of ethnicminority from the influence of undesirable peers and crime-related activities.Family Violence(a) crisis management and flexibility in the handling of casesHWFB/SWD3.27 Over the years, SWD has organized on-going training programmesfor social workers, which aim to, among other things, enhance their skills inrisk assessment, crisis intervention and other case management skills. Effortsin this area will continue. SWD has also engaged a consultancy to develop arisk assessment tool for use by front-line professionals. The study is nowunderway.The Police3.28 The Police consider that in addition to a scientific approach in thehandling of family violence, the need for flexibility and professional judgmentof the circumstances is essential in handling family violence. Hence the Policehave incorporated victim psychology into the training programmes forfront-line officers. They will also incorporate the risk assessment tool on103
family violence, to be developed by SWD following a study on the subject, intothe relevant police training programmes.(b) strengthening civic education and neighbourhood relationshipHAB3.29 HAB works closely with the Committee on the Promotion of CivicEducation (CPCE) in promoting civic education outside schools. CPCE hasadopted the themes of promoting family cohesiveness and social harmony in arange of publicity and educational programmes.3.30 In addition, HAD has also taken strenuous efforts to promotecommunity development, and to develop community participation. On thebasis of HAB/HAD’s solid foundation and strong liaison network, theGovernment will continue to foster the spirit of community participation fromall sectors and to enhance communications between the people and theAdministration.(c) evaluation and following-up of family violence casesHWFB/SWD3.31 SWD has commissioned a study on child abuse and spousebattering. The findings will help to shed light on the formulation of effectivemeasures to tackle the problem of family violence.(d) deployment of resources according to the needs of individual districts inhandling family violence problemsHWFB/SWD3.32 SWD has endeavoured to enhance the effectiveness of familyservices through services re-engineering, and to set up an additional Family andChild Protetive Services Unit through redeployment of resources.(e) establishment of a central database of family violence casesHWFB/SWD3.33 The Government agrees that a shared central database amonggovernment departments will help enhance inter-sector collaboration inpreventing and handling family violence. On this basis, SWD has104
strengthened liaison with the Police in the case referral process, and willcontinue to explore the possibility of sharing further case details among partiesconcerned, having due regard to the need to address the concerns about privacy.The Police3.34 A Police Domestic Violence Database has been established sinceMarch 2005 on cases of domestic violence reported in the past two years.As SWD is considering the setting up of a similar database to monitor domesticviolence cases, the Police will examine the feasibility of linking up theirdatabase with the SWD database in due course.(f) publicity work on domestic violenceHWFB/SWD3.35 In order to step up publicity on the prevention of domestic violence,SWD has since 2002-03 launched territory-wide publicity campaigns todisseminate messages on the need to strengthen families and encourage familieswith violence risks to seek early assistance. SWD will continue its efforts onthis aspect.The Police3.36 The Police have actively participated in public forums andseminars to increase public awareness on the seriousness of domestic violence.They will continue to provide assistance to SWD and NGOs to distributepublicity materials on the subject of domestic violence to the public at policestations.Commercial and Technology Crimes(a) co-operation among the Police, EMB and the parent-teacher associationsEMB3.37 One of the goals of the new IT in Education Strategy issued byEMB in July 2004 is Promoting Community-wide Support and CommunityBuilding. EMB will involve the community, in particular parents, andencourage them to motivate children towards the appropriate use of IT anddrive home messages on cyber ethics.105
The Police3.38 The Police have maintained close working relationship with EMBand PTAs in the promotion of cyber ethics for young persons and students,through the running of projects in collaboration with EMB, the PTAs as well asother stakeholders. A website for the promotion of cyber ethics has also beenlaunched by the Police.Cross-boundary and Quick Cash Crimes(a) publicity of crime prevention messages through the Police’s publicityprogrammesThe Police3.39 The Police will continue with their publicity measures in the formsof publicity campaigns and carnivals, posters and leaflets, vocal and visualbroadcasts at boundary-crossing points and on public transport, etc., to educatelocal residents as well as the tourists on the prevention of cross-boundary andquick cash crimes.(b) strengthening of communications with the administration and lawenforcement authorities in Guangdong and MacauThe Police3.40 The Police have maintained effective communications with lawenforcement authorities in Guangdong and Macau by means of regularintelligence exchanges and co-operation on individual crime investigations.There are also biennial forums attended by the Heads of Criminal Investigationof the three places with a view to strengthening police co-operation on differentcross-boundary criminal activities. Through close liaison with the lawenforcement authorities in Guangdong and Macau, the Police have attainedencouraging results in neutralizing vice establishments, arresting suspectedMainland prostitutes and core members of vice and bookmaking syndicates andthe seizure of significant amounts of suspected crime proceeds and betting slipsfor soccer gambling.Other Crime-related Issues(a) extension of closure period of vice establishments106
The Police3.41 Whilst closure order on vice establishments is effective in curbingvice activities, the Police consider that the present 6-month period of closureorder is striking a right balance between enforcement action and the interest ofthose landlords who may not be directly involved in vice activities. Inaddition to the execution of closure orders, which is just one of the measurestaken against vice activities, the Police also endeavour to neutralizecross-boundary vice syndicates through intelligence-led operations andco-operation with the Mainland authorities.3.42 Nevertheless, the Police may revisit the question of extending theperiod of closure order if situation warrants in future.(b) need for merging the Police Sai Kung Division and Tseung Kwan ODivisionThe Police3.43 The ultimate goal of realigning police formations is to provide abetter level of service and a more equitable distribution of police resources tothe local communities having taken due regard of the population of the areas inquestion, local unique features and crime situation. Other factors such asmajor town development plans and infrastructure projects which may directlyor indirectly affect the formations concerned will also be taken into account.There are currently insufficient justifications to fully support the merging of SaiKung Division and Tseung Kwan O Division having taken into considerationthe aforementioned factors. The matter will be kept under review inconjunction with the project on the realignment of police districts and divisionsin Kowloon East Region which is being examined in the light of the SoutheastKowloon (the former Kai Tak site) redevelopment plan.3.44 In the interim, the Police will closely monitor the situation in thesetwo divisions and, where necessary, deploy regional and district resources toaugment local police activities.*****107
CHAPTER 4COMMERCIAL CRIMESINTRODUCTION4.1 “Commercial Crime” is not a single and legally defined offence,but a mixture of fraud, commercial deception, false accounting, and otheroffences of a similar nature.4.2 The following sections provide an overview and comparativeassessment of the annual figures for commercial crimes recorded in 2004.COMMERCIAL CRIMES AND SYNDICATED FRAUDS4.3 Serious and syndicated complaints showed a downward trend of17% compared with 2003 and the reported loss involved was 2% lower. It isbelieved that the improving economy and police efforts in enforcement andeducation, coupled with recent enhanced awareness of and focus upon corporategovernance issues, have contributed to this trend.2003 2004 % ChangeNo. of Complaints 83 69 16.8%↓Total Reported Losses(HK$ million)1,514 1,485 1.9%↓4.4 Six topical commercial and syndicated frauds that havesignificantly influenced the society are highlighted below. They are Letter ofCredit Fraud, Pyramid Scheme Fraud, Loco-London Gold Fraud, ModellingAgency Fraud, West African Fraud and Bankruptcy Related Fraud.Letter of Credit Fraud4.5 During 2004, seven Letter of Credit (L/C) fraud cases werereported, which marked a decrease of 36% against 2003. Among the sevenreported cases, only two actually occurred in 2004. The remaining cases tookplace during or before 2003.4.6 The reported loss amount increased slightly compared to 2003. Itwas mainly attributed to one case that had incurred a loss of HK$171 million.108
4.7 A relatively high-profile and successful trial at the Court of FirstInstance during the summer of 2004 resulted in the conviction of theex-managing director of a company in Hong Kong and his two accomplices,with terms of imprisonment of four to four and a half years for kiting nine L/Csvalued at HK$48 million. This case reinforced institutional as well as thegeneral public’s awareness of this common type of fraud, and received moderatepress coverage. HK$60 million suspected proceedsare still restrained under the Organised & Serious Crimes Ordinance, and somecompanies suspected of operating PSR frauds have closed their business, whichis believed to have been in response to the Police’s rigorous enforcement andsuccessful prosecution actions.4.9 In the past 12 months, the problem of PSR fraud was apparentlywell contained. Proactive police action will continue. At present, theCommercial Crime Bureau (CCB) is closely monitoring the activities of 18suspected companies. Nine offenders were convicted in 2004 and sentencedto terms of imprisonment of two years and two months to four years, whileanother eight are awaiting trial.4.11 Proactive intelligence-based operations, stringent enforcementactions and successful prosecution with custodial sentences are believed to havesignificantly reduced such crime. The number of companies being reported and the losses incurredshowed no significant change compared with 2003.4.13 Most reported cases involved the voluntary signing of legalcontracts with victims enticed to make advance payment to secure a modellingjob. Potential victims were then told to attend facial treatment sessions indesignated beauty parlours under the pretence of presenting a better appearance.Following that, they then attended photo shooting sessions for a purportedreward of several hundred dollars. However, this monetary reward was only afraction of what the victims had paid in advance. No further employmentopportunities as promised have been offered. It is often difficult to provecriminality in such circumstances as the cases may be civil in nature.4.14 A multi-agency approach is adopted, i.e., with the ConsumerCouncil, Labour Department and RTHK, particularly in conducting publicitycampaigns to educate the public on the common methods employed byfraudsters in modelling agency fraud. Relevant figures are as follows -110

The victim was invited to contribute money to purchase the solutionin return for a portion of the “cleansed” money. This case resulted in theconviction of two West Africans who were sentenced to 21 months and 24months imprisonment respectively. Thedownward trend is mainly attributed to the increasing public awareness throughmedia coverage on related cases and successful police operation, as well aseducation through regular police publicity campaigns.Fraud Related to Bankruptcy4.17 There was a significant decrease of 78% in the number of reportsreceived in 2004 compared to 2003. The total amount of monetary loss for thesame period also dropped by 31%.4.18 In 2004, there were 11 prosecutions for cases of deception relatingto this type of fraud with nine convictions. The reasons for the significant111
decline in bankruptcy-related fraud are believed to be multifarious in nature.The improving economy, stringent enforcement action, the benefits of positivecredit-sharing between financial institutions and banks, and a coordinatedmulti-agency governmental publicity-based strategy are all factors leading tothis most welcome change in the trend. The victimswere offered jobs in shell trading companies and induced to invest in tradingproducts purported to be bringing them a big profit. They were subsequentlytold that their investments had failed and were accused of infringing thecompany’s business. The majority of the victims had therefore not reportedtheir case to police.4.20 Police undertook three operations in 2004, resulting in numerousarrests. 16 persons have been charged with offences including “Conspiracy toDefraud”, “Fraud” and “Obtaining Property by Deception”. As a result ofpolice enforcement actions and the successful implementation of an effectivepublicity campaign, similar syndicated employment fraud adopted a lowerprofile. The latest police intelligence revealed that perpetrators would try torecruit victims in the street rather than through newspaper advertisements inorder to minimize police interference. It is anticipated that with unemploymentfigures declining, less members of the public will fall victim to employmentfraud.Insurance Fraud4.21 In November 2004, the CCB arrested 13 directors and managementstaff of seven local insurance brokerage companies. The fraud involved thegranting of large commissions as incentives to the brokerages by three largeinsurance companies for new policyholders introduced by them. For those112
clients who would not continue their policy subscriptions, the brokerages haveto repay these immediate and relatively large commissions to the insurancefirms. These criminal and syndicated brokerages exploited this system bydelaying repayments, only to eventually evade all liability by declaringthemselves bankrupt between June and September 2004. The insurancecompanies suffered a loss of HK$48 million.4.22 The incentives offered by the brokerages to prospective clientswere indicative of the nature of the scam, as many policies were offered free ofcharge, employment perks or as part of a lucky-draw prize. The Office of theCommissioner of Insurance has since tightened up measures to prevent similaroccurrences.Internet Banking Theft4.23 In 2004, 19 reports relating to Internet Banking were received.The total reported losses amounted to HK$2 million. These cases includedunauthorised online credit card transactions, the setting up of fraudulentaccounts as well as the unauthorised increase of credit card limits for cashwithdrawal and purchases.4.24 “Phishing” emails and bogus banking websites were also used todeceive victims of their personal details and passwords. Culprits succeeded instealing funds from the victims’ accounts and moved the stolen funds out ofHong Kong through remittance agencies. 29 persons were arrested in thisinternational scam. Nevertheless, none of the incidents involved a bank’scomputer system being compromised.Child Pornography4.25. With the enactment of the Prevention of Child PornographyOrdinance on 19 December 2003, the Hong Kong Police have endeavoured tocombat this disturbing crime. An intelligence-led operation codenamed“Storm-rider” was undertaken by CCB in March 2004. This operation resultedin the arrest of a total of 24 males with a seizure of abundant child pornographicmaterials in digital format. After seeking legal advice, 16 males were chargedwith the offence of “Possession of Child Pornography” and appeared in variousMagistracies. 13 out of 16 males have so far been convicted, and sentencesincluded several months of imprisonment for these ground-breakingprosecutions.113
CONCLUSION4.26 A number of successful operations and convictions in differentareas of commercial crime were witnessed in 2004. A downward trend wasnoticed in a majority of topical crimes. The CCB will continue to take aproactive approach to existing and developing commercial crime typologies inthe coming year.*****114
CHAPTER 5NEW INITIATIVES ONOFFENDERS’ REHABILITATION PROGRAMMESBACKGROUND5.1 Protecting the community cannot be done by just segregatingoffenders from the public. Since almost all offenders will finally return to thecommunity, it is essential that they do not commit more crimes and return toprisons through a revolving door. One of the primary tasks of the correctionalservices is to prepare them for re-integration into the community as law-abidingcitizens.5.2 The Correctional Services Department (CSD) is committed todeveloping comprehensive treatment and rehabilitation programmes to meet therehabilitative needs of different types of prisoners. Through internalredeployment, collaboration with its service partners and community support,the Department has introduced three new initiatives to enhance prisoners’re-integration into the community without incurring additional governmentresources.THE NEW INITIATIVESEnhanced Re-integration Programme5.3 Many offenders have experienced difficulties in securing jobs afterdischarge and unemployment is one of the main risk factors for recidivism.While prisoners under 21 years of age receive compulsory half-day vocationaltraining on industrial or commercial skills, adult prisoners are required to workto keep them meaningfully occupied. To facilitate the re-integration of youngadult prisoners into the community, CSD introduced in November 2003 theEnhanced Re-integration Programme, a two-phase programme which engagesmale prisoners aged 21 and above in full-time vocational training in a youngoffender institution on a voluntary basis.5.4 To be eligible for the Programme, prisoners need to have a goodtrack record of institutional behaviour and have attained at least juniorsecondary education level. The balance of their sentence should be between 6and 18 months (reduced to 12 months in phase two of the Programme) so thatthey could complete at least one vocational course and obtain accreditationbefore release. Under the Programme, the participants receive vocational115
training in specific areas, and are subject to the rules and regulations (e.g.prohibition of smoking) of young offender institutions.5.5 After acquiring the relevant skills and qualifications, theparticipants will stand better chances of employment upon their release. Tofacilitate follow-up guidance such as job counselling and placement service,participants would undergo voluntary monitoring by community organizations,if they are not already subject to statutory supervision. In phase one of theProgramme, eight participants aged between 21 and 25 successfully completedthe vocational training in catering service and commercial skills. In phase two,starting in early 2005 CSD will provide full-time vocational training in printingand desktop publishing to participating male prisoners aged between 21 and 30.CSD Rehabilitation Volunteer Group5.6 Adult offenders may participate in educational studies on avoluntary basis. To support their studies, CSD organizes evening classes onvarious subjects for them to attend after work. To achieve efficiency savings,CSD has to focus on its core services. As a result, the Department no longeremploys part-time teachers for such classes. In order to provide continuedassistance to prisoners in their educational and cultural pursuits, the Departmentconducted a volunteer recruitment exercise in late 2003.5.7 After a successful recruitment drive, the CSD RehabilitationVolunteer Group formally commenced operation in March 2004 with 43volunteers (comprising 40 university students and three teachers). Withcontinuous efforts, the Group has recruited 120 registered volunteers by the endof 2004, with a total of 78 interest groups and hobby classes conducted for 900prisoners in 20 institutions since March 2004. The classes covered a widerange of subjects, including language, computer, handicraft, etc. Thevolunteers have also assisted in other areas of rehabilitation work, such as publiceducation activities for promoting community acceptance of rehabilitatedoffenders.5.8 CSD will continue to recruit volunteers to meet new demand forclasses and interest groups. Prisoners with good institutional behaviour andrelevant academic qualifications or professional skills will also be selected on avoluntary basis to assist the volunteers.Continuing Care Project5.9 CSD provides statutory aftercare supervision for young prisoners,persons released from detention, rehabilitation, training and drug addiction116
treatment centres, and prisoners released under various supervision schemes.In 1997, CSD implemented a collaborated pilot scheme with the MethodistCentre. Under the scheme, the Department would refer supervisees of ShaTsui Detention Centre to the Methodist Centre for follow-up if they, aftercompleting the one-year statutory supervision, are still found to be in need ofand would like to continue to receive counselling services.5.10 The outcome of the pilot scheme is encouraging as the participants’recidivism rate is one third below that of their counterparts, i.e. 11.0% vs 17.7%.The Department has therefore decided to extend the scheme to cover prisonersunder all supervision schemes. With the support of seven religious bodies andvoluntary organizations (see list at Appendix XV), the extended scheme waslaunched in February 2004 with 137 supervisees participating. It is expectedthat some 200 supervisees will benefit from this initiative each year. CSD willconduct a review on the effectiveness of the scheme in 2005.WAY FORWARD5.11 FCC welcomes the new initiatives taken by CSD in therehabilitation of offenders and the re-integration of rehabilitated offenders.CSD will continue to seek community resources and collaboration to assist inthe Department’s rehabilitation programme.*****117
BACKGROUNDCHAPTER 6PUBLICITY CAMPAIGN FORREHABILITATED OFFENDERS IN 2004-056.1 Public acceptance and community support are essential forsuccessful re-integration of offenders into society as law-abiding citizens. TheCorrectional Services Department (CSD) has therefore organized a series ofpublicity initiatives since 1999 to help the public better understand the needs ofand the problems commonly faced by rehabilitated offenders, and to appeal forcommunity support for them.6.2 Major publicity activities held for this purpose included three seriesof the TV docu-drama “The Road Back”, Radio and Television Announcementsin the Public Interest (APIs), symposiums on employment for rehabilitatedoffenders, special TV programmes, competitions for inmates to demonstratetheir talents in cultural and recreational activities, variety shows andcommunity-involvement activities jointly organized with District Fight CrimeCommittees (DFCCs).2004-05 PUBLICITY CAMPAIGN6.3 Having regard to the advice of the Committee on CommunitySupport for Rehabilitated Offenders * , the effectiveness of past publicityactivities and the Department’s own experience, CSD conducted another seriesof publicity activities in 2004-05 targeting four community groups (namelystudents, general public, employers and district groups) to secure their support inthe re-integration of rehabilitated offenders. In addition to DFCCs, CSDinvited non-governmental organizations (NGOs) and charitable organizationswith interest in the welfare of rehabilitated offenders to jointly implement thefollowing promotional and public education activities -a) For Students• With the support of the DFCCs, CSD held a joint schoolstudent forum in December 2003 at the Hong KongConvention and Exhibition Centre to provide opportunities forsecondary school students and rehabilitated offenders to* Comprising members from different sectors of the community, the Committee advises the Commissioner ofCorrectional Services on rehabilitation programmes and re-integration strategies.118
interact and discuss the untoward consequences of committingcrimes. Thereafter, 10 district-based student forums, eachparticipated by about 150 nominated students and other invitedguests from concerned community groups, were held in 2004.CSD will conduct more school forums in other districts in2005 and review the effectiveness of the activity aftercompleting a round of forums in all 18 districts.b) For General Public• New posters carrying the publicity message were displayed inbus stops and tram stops during 2004.• New Radio and Television APIs were produced and broadcaston the television and radio starting from May/June 2004, sothat appeal for public support for rehabilitated offenders couldreach different sectors of the community.• The third series of the TV docu-drama on rehabilitatedoffenders “The Road Back” was broadcast from September toNovember 2004 with an average audience of 18% (or 1.2million people). As with the first two series broadcast in 2000and 2002 respectively, CSD would produce DVD copies of theprogramme for distribution to schools, voluntary organizations,youth groups etc. as teaching and counselling material forstudents and teenagers.• Short video excerpts about the rehabilitation services wereproduced and uploaded onto CSD’s website for viewing by thepublic, potential employers, etc. to enhance their understandingof the institutional training and rehabilitation programmes forprisoners.• A special TV programme entitled “Variety Show forRehabilitated Offenders” was produced and broadcast by theTelevision Broadcast Ltd. on 26 November 2004 to promotethrough a soft approach community acceptance of rehabilitatedoffenders.• “An Unparalleled Show 2004” highlighting inmates’ talents incultural and recreational activities was held on 3 December2004. Apart from promoting public acceptance ofrehabilitated offenders, the Show also brought out the119
importance of partnership with NGOs and individuals in thedelivery of rehabilitation services.c) For Employers• CSD jointly organized with the Centre for Criminology of theUniversity of Hong Kong the third employment symposium forrehabilitated offenders in March 2004 to arouse potentialemployers’ interest in employing rehabilitated offenders.Through co-operation with local commercial and industrialorganizations, a record number of 400 participants turned up atthe event.• CSD continued to organize institutional visits for potentialemployers to enhance their understanding of the department’srehabilitation services and programmes, in particular thevocational training for offenders and the work skills obtainablein correctional institutions.d) For District Groups• Since 2001-02, DFCCs have organized rehabilitation-relatedpublicity activities jointly with CSD. These included visits topenal institutions, exhibitions, experience sharing withinmates/prisoners, variety shows and voluntary work.• Given the success of the co-operation, the DFCCs support thecontinuation of the initiative at a briefing held by CSD in June2004. Regional Liaison Officers of CSD have been appointedto co-ordinate these district promotional activities.6.4 Apart from the above major publicity and public educationactivities, other publicity initiatives implemented in 2004-05 included a specialvariety show held on 6 November 2004 during the CSD Autumn Fair, inclusionof publicity messages in Government bills and appointment of a famous artiste,Mr Andy Lau, as Rehabilitation Ambassador in October 2004 to help appeal forcommunity support for rehabilitated offenders. Through the CSDRehabilitation Volunteer Group established in early 2004, volunteers,comprising mainly teachers and university students, have been providingassistance and guidance to prisoners and support in the publicity campaign.The Department continued to reach out to community organizations, such asZonta Club, Lions Clubs, Rotary Clubs, Care for Rehabilitated Offenders120
Association, etc. to solicit volunteers and expertise in organizing interest classesand skills training for serving offenders.WAY FORWARD6.5 Community support is a key factor contributing to the successfultransition of rehabilitated offenders to law-abiding citizens. This will in turnhelp reduce recidivism and save public expenses. CSD will continue with itspublic education efforts to promote public acceptance of rehabilitated offendersand invite the society to participate in offenders’ re-integration.*****121
CHAPTER 7PROGRESS OFPOLICE SUPERINTENDENTS’ DISCRETION SCHEMEBACKGROUND7.1 Under the Police Superintendents’ Discretion Scheme (PSDS), aPolice officer of the rank of Superintendent or above may, at his or herdiscretion, caution a young offender instead of initiating a criminal prosecutionagainst the offender. With effect from 1 September 1995, the age ceiling ofoffenders eligible for the PSDS was raised from the age of under 17 years old tounder 18 years old so that more young offenders may benefit from the Scheme.The Fight Crime Committee (FCC) monitors the progress of the PSDS throughthe half-yearly progress reports submitted by the Commissioner of Police (CP).OVERALL SITUATION7.2 A total of 7 566 juveniles (for the purpose of this report, a juvenilemeans a person under the age of 18) were arrested for various criminal offencesin 2004, representing a decrease of 7.2% compared with 2002 (8 156) and adecrease of 4.4% compared with 2003 * (7 918). The five most commoncriminal offences committed by juvenile offenders in 2004 included shop theft,miscellaneous thefts, wounding and serious assault, robbery, and offencesagainst public order (see chart at Appendix XVI).7.3 Not all arrested juveniles are eligible for the PSDS. For thosearrested in 2004, 51.9% were eligible for the Scheme, compared with 54.7% in2002 and 50.4% in 2003. The following guidelines for assessing the eligibilityof juvenile offenders for the Scheme remained unchanged -(a)at the time the caution is administered, the offender is under the ageof 18 years;(b) the offender has no previous criminal record;(c)the evidence available is sufficient to support a prosecution;(d) the offender voluntarily and unequivocally admits the offence; and* As from 1.7.2003, the minimum age of criminal liability has been raised from 7 to 10.122
(e)the offender and his parents or guardian agree to the caution.7.4 Altogether a total of 2 929 juvenile offenders were cautioned in2004, a drop of 12.4% compared with 2002 (3 345) and a drop of 2.8%compared with 2003 (3 012). This gives a caution rate of 38.7% out of thejuveniles arrested, compared with 41.0% in 2002 and 38.0% in 2003. 7.7 Juveniles who have been referred to the JPS for supervision will besubject to regular visits by a member of the JPS team who will have an informalinterview with the juvenile in the presence of his or her parents at their home.Such visits will normally last for two years or until the juvenile’s 18th birthday,whichever is earlier.7.8 The usual interval of such visits is once a month, but may varyfrom, say, every two weeks for juveniles assessed as being at very high risk, toonce every three months for those at low risk. Subjects covered during theinterview include -(a)(b)(c)the juvenile’s academic progress;leisure activities; andfriends and associates, etc.7.9 The JPS has regular liaison with the SWD and EMB, and oftenconsults them about problems in the juveniles’ families. The JPS also refersjuveniles under supervision to the CSSS, the Junior Police Call, the Hong KongAward for Young People or other organisations as appropriate.7.10 Since mid-1997, the Police have referred increasing numbers ofjuveniles to the CSSS, either as an alternative or as a supplement to the JPS.The purpose of the CSSS is to encourage juveniles who have infringed the lawto return to a decent law-abiding life-style, by means of -(a)(b)(c)(d)(e)(f)counselling or supportive groups;job training and placement;skill learning classes;adventure and outdoor activities;volunteer and community service projects; andprograms for parents / guardians.RECIDIVISM7.11 A person is regarded as a recidivist if he or she is re-arrested forcrime within two years from the date of the caution, or before he or she reaches124
18 years of age, whichever occurs first. The recidivist rate for the juvenilescautioned in 2002 was 17.7%. This is compared to 18.0% for those cautionedin 2000 and 18.9% for those cautioned in 2001. BACKGROUNDCHAPTER 8FIGHT CRIME PUBLICITY STRATEGY8.1 The Publicity Sub-Committee (PSC) formulates the strategy for theFight Crime Publicity Campaign, which starts in early summer every year.The strategy, which usually embraces one or more themes targeting prevailingcrimes and/or areas of major community concern, will be implemented by thePSC following the endorsement of the Fight Crime Committee.REVIEW OF THE 2003-2004 CAMPAIGN8.2 The 2003-04 campaign was accorded a major campaign status witha budget allocation of HK$1.6 million.8.3 Anti-deception was made the first theme of the campaign with theslogan ”Beware of street deception”. Back in 2002, the PSC produced apopular radio programme jointly with Radio Television Hong Kong (RTHK),which appealed to senior citizens to watch out for unscrupulous persons makingdubious offers in buying and selling electronic parts and medicine as well asbogus services of spiritual treatment, etc.8.4 Building on the success of the radio programme, during the year2003-04, the PSC continued to co-operate with RTHK to produce aneight-episode TV drama series “City Swindlers” to expose tricks employed invarious disguises. The TV series was so successful that, according to findingsfrom ACNielsen, each of its eight episodes attracted as many as 1.3 millionviewers aged four and above. The episodes were later re-produced into CDsfor distribution to community centres and homes for the aged, etc.8.5 The campaign message was reinforced by other publicity itemsincluding TV and radio Announcements in the Public Interests (APIs), posters,newspaper advertisements and outdoor advertising in an all-out drive to call onthe community to stay alert.8.6 In response to the rising number of “quick cash crimes” such aspickpocketing during the first few months of the year, the PSC madeanti-miscellaneous thefts the second theme of the campaign with the slogan"Take good care of your belongings” and a publicity package was launched inlate October to remind people to always keep an eye on their personalbelongings.126
PUBLICITY STRATEGY FOR 2004-05 CAMPAIGN8.7 The 2004-05 campaign continued to enjoy a major campaign statuswith a budget allocation of HK$1.6 million.8.8 Since common crimes such as youth crime, computer crime, shopthefts, burglaries, street deception and miscellaneous thefts had already beencovered by the campaigns over the last few years and the publicity materialsproduced were still of relevance and could be made use of to address theproblems as and when required, a novel approach was adopted for the FightCrime Publicity Campaign 2004-05.8.9 “Help police fight crime” was the theme of Fight Crime PublicityCampaign for 2004-05 to promote awareness of members of the public in thatthey had a key role to play in the fight against crime. Their co-operation withand support for the Police through acts as simple as making a phone call wasvital to both the prevention and detection of crime.8.10 Phase One of the campaign was launched in June 2004 andthrough a series of publicity drives, members of the public were reminded tostay alert against crime and to take a more proactive approach by using their‘weapons’ – eyes, ears, mouth and hands to prevent, detect and report crime tothe Police.8.11 Rolled out in December 2004, Phase Two of the campaign echoedthe same theme and appealed to members of the public to make use of their“weapons” to bring crimes to light.8.12 The campaign came with two TV APIs and two complementingradio APIs, posters, bus body advertising and other outdoor electronic mediaplacements. The TV APIs were also uploaded onto the Governmenthomepage – the Government Information Centre.8.13 At the district level, District Fight Crime Committees, JuniorPolice Call and Police crime prevention officers etc continued to join hands inorganising fight crime activities in support of these two campaign themes tohelp put across relevant messages to different sectors of the community.*****127
INTRODUCTIONCHAPTER 9WORK OF DISTRICT FIGHT CRIME COMMITTEES9.1 District Fight Crime Committees (DFCCs) were first established inSeptember 1976, mainly for the purpose of promoting public awareness of theFight Crime Campaign through organising activities at district level. Sincethen, DFCCs have developed into a focal point for community efforts to fightcrime and their terms of reference, at Appendix III(a), have been broadened toinclude -(a)(b)(c)(d)monitoring the state of crime and law enforcement in thedistrict;co-ordinating district campaign activities;promoting good relationship between the Police andmembers of the public; andadvising the Fight Crime Committee (FCC) on general lawand order issues.9.2 There are 18 DFCCs based on the same geographical boundaries asthe District Councils. DFCCs are independent of District Councils but the twoare very closely related in terms of membership and funding arrangements.MEMBERSHIP9.3 DFCCs have an average size of 34 members. They are chaired bylocal community leaders with a large number of appointed non-official membersdrawn from all sectors of the local community and a small group ofrepresentatives from key local government offices. In 2004-05, there was atotal of 504 non-official members on the 18 DFCCs and many of them areDistrict Council members. Membership lists of the 18 DFCCs are atAppendix III(b).MONITORING CRIME SITUATION IN THE DISTRICT9.4 DFCCs met every two or three months. Law and order remained astanding item on their meeting agenda. They kept under constant review thestate of crime and significant trends in district crime statistics. The meetings128
provided a forum where local crime issues were discussed.9.5 Each district has its own crime characteristics due to geographical,demographic and developmental differences. Crimes which have drawnDFCCs’ attention in the report period included -• robbery, burglary and building security issues• juvenile and youth crime and problem of drug abuse• triad-related crimes and vice activities• quick cash crimes such as shop-theft and street deception• crimes committed by illegal immigrants and two-way exitpermit holdersCO-ORDINATION OF COMMUNITY EFFORTS9.6 DFCCs launched district fight crime publicity campaigns withfunds from District Councils and other sponsorship. In addition to the mainpublicity strategy, individual DFCCs also adopted special themes targeting thecrime characteristics of the district. Some DFCCs also conducted studies andsurveys on local crime problems.9.7 Campaign activities undertaken by DFCCs in the report period tooka variety of forms, including exhibitions, talks, seminars, variety shows,carnivals and various award schemes, contests/competitions, publication of fightcrime newsletters and distribution of fight crime publicity items. Visits toPolice command and control centres, Police stations, Correctional Servicesinstitutions, drug addiction treatment centres were also organised.LINK BETWEEN FCC AND DFCCs9.8 The FCC received and considered regular progress reports on thework of DFCCs. It also provided advice to DFCCs on their work. A briefreport of the matters discussed in FCC meetings was also prepared after eachmeeting and circulated to DFCCs for information. In addition, FCC membersattended DFCC meetings on a roster basis and brought district concerns back toFCC meetings for discussion. At Appendix III (c) is the roster of visits ofFCC Members to DFCCs in 2004. FCC Members also participated actively inpublicity activities organised by DFCCs. These arrangements not onlyenhanced the exchange of ideas and information on measures to combat crime,129
ut also established a means for positive communication between members ofFCC and DFCCs.9.9 To reinforce the close link between the FCC and DFCCs, socialgatherings were also organised. An annual dinner with the DFCC chairmenwas held on 18 March 2004, and the 2004 Fight Crime Conference attended byall DFCC members was held on 22 November 2004. These gatheringsprovided opportunities for members of the FCC and DFCCs to get together todiscuss areas of public concern and to exchange views on ways to combat crime.*****130
CHAPTER 10WORK OF SUB-COMMITTEESSTANDING COMMITTEE ON YOUNG OFFENDERS10.1 The Standing Committee on Young Offenders (SCOYO) of theFight Crime Committee (FCC) was established in July 1986 by reconstitutingthe FCC’s Working Group on Youth. Its key objective is to examine factorswhich affect young people at risk of involvement in crime and to considerpreventive and remedial measures that can be taken both within and outside thecurrent education, social and correctional programmes. The terms of referenceand membership list of SCOYO are at Appendix II (a).10.2 One of the tasks of SCOYO was to monitor the work of the YoungOffenders Assessment Panel (YOAP), comprising professional staff from boththe Correctional Services Department (CSD) and the Social Welfare Department(SWD), which recommends on the most appropriate programme ofrehabilitation for convicted young offenders. A review on the resource supportfor the YOAP was being undertaken by CSD and SWD respectively and theoutcome of the review will be reported to SCOYO for consideration in duecourse.PUBLICITY SUB-COMMITTEE10.3 The Publicity Sub-Committee (PSC) of the FCC publicises thepolicies, objectives and strategies of the FCC, with a view to fostering publicawareness of crime prevention and motivating the community to play an activerole in the fight against crime. The terms of reference and the 2004-05membership of the PSC are at Appendix II(b).10.4 The PSC is responsible for formulating and implementing the FightCrime Publicity Campaign. This annual campaign usually embraces one ormore themes targeting prevailing crimes and/or areas of major communityconcern. Details of the 2004-05 Fight Crime Publicity Campaign are set out inChapter 8.10.5 In 2004-05, the PSC held 12 meetings. It planned andimplemented a territory-wide fight crime publicity campaign through the use ofthe mass media and community programmes such as the Good Citizen AwardScheme. The PSC also worked closely with District Fight Crime Committeesin planning and organising publicity activities at district level in support of theterritory-wide campaign.131
GOOD CITIZEN AWARD SCHEME10.6 Sponsored by the Hong Kong General Chamber of Commerce, theGood Citizen Award (GCA) Scheme was first introduced in 1973 by the FCC togive recognition to members of the public for their help in the fight againstcrime. To further arouse public interest in the Scheme, an additional honour -the Good Citizen of the Year Award was introduced in 1984 for civic-mindedcitizens in appreciation of their exemplary courage in preventing or helping todetect crimes or in apprehending culprits.10.7 Two presentation ceremonies were held in June and December2004 during which a total of 81 citizens were commended. So far, more than3 000 citizens have been commended under the GCA Scheme.*****132
